    Hi jaybag

    Defaults are ok(honest!!) the earlier you get them, the earlier they drop off your credit file (all they really are is a big black mark on your credit rating)- and usually it means interest and charges STOP!!! The defaults shows for 6 years from date of the default notice - not from date of debt being cleared - which is why the sooner you get them the better :D

    They sometimes pass on to a DCA afterwards - but not always. Mint have defaulted a loan and cc I have with them and still not passed it on anywhere ;)

    Don't worry too much, but if they do pass it on to a DCA then you will need to notify your DMP company as they will need to know who to pay ;)

    Donna how far into it did you claim charges back? .. As yet.. I don't really have any. So I was thinking of waiting until the charges really do start piling on.. and do it some times after that.. :confused: Once you have claimed... can you claim again? ... When all this claim back charges thing first started, I claimed £360 back from HSBC.. and I THINK I remember something in the final letter they sent me.. confirming I could have it back.. about them not even ever doing it again.. or me agreeing to not ever try to claim them back again.. I cant remember now.. but it was something along those lines. xx

    Just had a CCA from nat west a copy of an agreement with no signature on looks like cap one, Halifax, and natwest, cannot supply true agreements where dose this help us down the line are they unenforceable if so what protection will it offer ???

    RBOS.. (credit card) a reply to my first letter. (in case this helps anyone else with them)

    Quite polite.. not nasty or scary.. just saying 'Thankyou for your Financial statement (SOA).. Before your offer of payment is considered.. (tough! I'm setting up a standing order, so you WILL get it whether you 'accept' it or not ;).. A default notice will be issued.. (what? already? YAY :T) ... This will be followed by a Termination letter 21 days later, formally cancelling the facility, as you are unable to make payments in accordance with the T&Cs.

    Our debt recovery Office will contact you shortly with regard to your repayment proposals, and the suspension of interest charges (WOOHOO! :T) ... Please note.. interest will continue to be added to your account, until the payment proposals are accepted... (hmmmm...:rolleyes:) ...

    Should a third party be dealing with your account please forward this letter to them.
    (Nope.. doing DMP it myself)

    If you have not already done so, please return you card (s) Cut it in half for security reasons.

    Also... I have only had ONE missed call from HSBC since I finally plucked up the nerve to answer the phone. (After 11 days of NON STOP calls.. 10-15 per day)

    .. (that was fast!)
    Still not nasty or scary tho.. Phew!

    Something along the lines of
    'Thankyou for telling us you are unable to correct the position of your account because of your financial problems. We think the best course of action now is to withdraw your CC facility, so we enclose a Default notice which you should read carefully. We have to send you a notice of default by law before we can terminate your account. (gawwd! wish they would ALL do this!) .. with you and arrange a repayment programme.

    At the end of the stipulated period, your agreement will be formally terminated and we shall again contact you with regard to repayment of the outstanding balance.
    You will not be able to use your card (return it, cancel any DD) etc etc. (all nice and polite)

    .. Phew... thats not too bad then. :T (so far.. anyway haha!) :rotfl:

    I have made a boo boo, I have been ebaying hard for the past month & made £100 to save towards my kids birthdays & christmas, & guess what accidently had it sent to the wrong bank account, one the is included in my DMP! assume there isnt any way to get that back now??

    is the account closed or is it an overdraft?

    Similar happened to me recently (altho it was less). Two people paid money into my old account instead of new! i can't get this back because (because of the charges) I'm over the overdraft limit so I have 'zero available'. however my account isn't frozen as it's got the overdraft and i don't believe they freeze it until it's paid off (could be wrong, they are the only one who haven't acknowledged the DMP) so i think, had my balance been within the o/d limit, I could (and would) have just taken this money out like i would have done when i used to use it! obviously i didn't get to try this tact so this is only an assumption!! but yo could try just taking it back! Unless the account is closed i guess!

    not massivly concerened with the defaults,as you say the sooner they are on,the sooner they will come off-I know my credit rating will be shot to pieces anyway,bummer really,spent all this time trying to keep it good then it all goes wrong! oh well...not the end of the world
    It feels like I have been in this DMP for ages the ammount of time I have spent thinking/reading about it,the first payment hasnt even come out yet!!!?!?

    A lot of my creditors have started to put charges and interest on the ammounts I owe,I am going to give it 6 months or so to let it all settle then try and hit them for refunds-should be fun...

    Re requesting a CCA,can I ask for one for my credit cards as well as my loans? Still am in 2 minds to start this just yet,sounds like it is a bit full on with requesting them and with letters going back and forth,and the thread on CCA's is a little confusing....
    anyone help with this?
