    yes sadly it was sent a week ago, only realised the mistake when it didnt turn up in my new account & cant check that its in the old account as it wont let me log in now

    Similar happened to me recently (altho it was less). I got 3 letters from the CCCS today, for all 3 ofour lloyds overdrafts, they all say the same...LLoyds have not accepted the offer they made as they say the account numbers dont exist! they say they will make the payments anyway...what does this mean? how can the accounts not exist?

    Oo thats weird.. (and maybe a good thing ;) .. haha!

    I'm joking.. hmmm... Did you double check the numbers you gave CCCS? .. Mind you.. I can see ONE being wrong maybe.. but not all of them.

    It might be worth asking this on the main DFW board.. more people 'in the know' will get to see it.

    Something along the lines of
    'Thankyou for telling us you are unable to correct the position of your account because of your financial problems. We think the best course of action now is to withdraw your CC facility, so we enclose a Default notice which you should read carefully. We have to send you a notice of default by law before we can terminate your account. (gawwd! wish they would ALL do this!) .. with you and arrange a repayment programme.

    just wanted to alert you,,,,keep the envelope and the dn and ensure its actually giving you 14 days from when you receive it to when you have to pay the default amount to avoid the default if that makes sense

    a lot of my dn have not complied fully in the way they should be set out ie,,,a lot of bold and capital letters highlighting the critical parts of the dn and also not giving me the clear 14 days,,,it is then defective, a good defense can be done,,,,if they go on and terminate you then all they would be entitled to is the arrears figure, im sure a lot less than the balance, the law is very clear on the default notice being set out and being sent out correctly

    its a bit of battle but hey ho, its a worthwhile one to fight back on,,,lots of case law and if can put your arguement across correctly its worth a shot in defending this if it ever gets to court

    its my next mission to understand fully

    keep all correspondence and all envelopes attached, in a file thats what i now do

    I thought I wanted them to default me.. (I don't care about the credit file 'mark'.. it is the least of my worries) I thought the faster they default me the better.. getting interest/charges stopped etc etc?

    Sent all letters/offers etc Recorded Delivery on 15th May.

    Now two weeks later.



    Cashed* (about a week after being sent)


    Barclays OD
    Still not cashed token payment.

    Barclaycard.. Cashed.
    Barclaycard cash card. Cashed

    Cahoot Loan .. Cashed. 28th May~ Got letter of outstanding arrears. 29th May ~ Sent reply saying I have already written 14 days ago (to wrong address!) To notify them of my DMP etc. Sent copy of first letter (recorded) this time to right department haha. :rolleyes:

    Cahoot OD.. Cashed

    HSBC Card.. Still not cashed token payment.
    HSBC Loan .. Still not cashed token payment.

    Halifax.. Cashed.
    Egg.. Cashed.

    Hitachi Capital (DFS Sofa) Still not cashed.. but replied saying no way to offer, they want the money NOW.

    RBOS.. Still not cashed. BUT! 28th May: Sent me ‘nice letter’ and also a default notice letter, (they say by law they have to) and I await their DC department to get in touch. (I'm happy with this ~ I think.. Maz?? haha!)

    Morgan Stanley Card.. Cashed

    Capital One card .. Cashed. 28th May received ‘Nice letter’ Offering to help, freeze interest and asking for more info. (bank statement/wage slip/proof of benefits ~ which I AM sending but only because they were nice ;) (I know we don't HAVE to)
