a few creditors have accepted the new payments but one is being painful!
theyve sent five letters in three days all saying different things ...-
they want copy of bank statement - done last week
they want copy payslips-done last week
they want us to set up a standing order-done last week
they want the letter signed-done although wasnt sure he shouldve signed it
and today we had a letter saying they wont accept our letter as the signatures dont match their one on file!!? so they just sent a short letter saying they cant help us as the signatures dont match!
Hi there.
Unfortunately often creditors assume that because you've had advice from us it means that you are offered a DMP. Creditors often expect us to contact them on behalf of clients when we have no authority to do so. We can only act on behalf of a client once a client has signed a DMP authority form.
You've sent them a lot of information in order to help back up your offer of payment, but you're not actually obliged to do any of this. We would normally suggest that by sending a copy of your CCCS budget would be sufficient evidence to justify your offer of payment. Of course if you are comforatable sending them other documents too, you can do.
However I wouldn't allow yourself to be held ransom by them. My advice would be to set up the Standing Order yourself and perhaps write to them once more to say you've sent them everything you can do to back up your offer and you are going to continue paying the amount until your circumstances change. I wouldn't call them, as you tend to get more resistance speaking to someone over the phone and it's also expensive. Once they establish the fact you're not going to keep jumping through hoops for them, hopefully they will start to realise it's not worth pursuing further and move on to someone else.

As for doing your own DMP .. Maybe you should go for it.. If debt management comps are (possibly) going to be leading people that way anyway..
Maybe you would get headed that way? .. Thats what happened to me.. (because I didnt have enough surplus income for them to take me on They gave me all the info, sent me a pack thing. . (gave me a case number) and told me I could still call for advice etc.. and sent me on my merry way.
AND.. if you have read on here.. lots of people ON debt management DMPs have/are deciding to to come off and do it themselves. (for better control of what's going on)
I was thinking too.. at least if you are doing it yourself.. you can act on things immediately if needs be.. instead of waiting about for them to get through all the countless cases before they come back to yours. (I thats how it works assume anyway)
For me.. the way I am trying to see it.. Is if I can at least ride on the next month or so.. I will be fine. (I HOPE!!) :eek:
I think it's just going to be that intial flurry of calls letter/threats/offers blah blah blah.. until it all settles down.

Saskia, I don't know how it works if you work for a bank but I think CCCS and Payplan require (or prefer, not sure which) you to have ALL of your debts on the plan, which might make it better for you to go it alone anyway. as they won't like the idea of you having a loan that isn't included on the plan. I think it's just because they want to be 'fair' to all the creditors and show them all the same treatment and not seem to be giving preferential treatment to any of them.
Eupho I think you're doing a grand job! you do seem very organised with it all.
Personally I'm happier with Payplan, coz i send one payment a month and they deal with all, and theoretically deal with any problems that may occur with the creditors. Means i now don't have to think about it ALL the time! I guess i do prefer the easy life after all!
Oh and here's something I found yesterday and really enjoyed reading. it's long and I'm only on pg 22 (it's good up to them, no idea what comes next). Thought you all might enjoy it too!

haha.. thats how I am trrrrrying to see it too.
I'm trying to see this now.. as a 'task' a 'challenge' .. to get this sorted (somehow) and get it out of my life (eventually!).. and you are right.. what's the worst they can do? .. whatever they do.. we will still be alive and breathing. :beer: (thankfully!)
They can't take what we don't have.. and thats the bottom line.
So all we can do is show willing to pay what we owe..
and do what we can to pay it back.

I was just thinking.. One thing Sas could add on her correspondence if that does come up .. is that she DOES work for HSBC... and the circumstances are different for that debt. That she would risk losing her job etc... and would therefore PROBABLY be unable to pay anyone any money at all.

No you are saying it to yourself and everyone else reading, it's reassuring and helps to keep positive, I can honestly say for the first time in a long time I feel I may have a decent future and have something to look forward to and keep imagining the actual day I become debtfree and never will I ever borrow again, never. never, never, EVER.:D:D:D

Wow Eupho they're being painful, which creditor is asking for all this? I would'nt send anything else now, it looks like they're trying to fob you off by saying the signatures don't match, hmmmm perhaps you could turn that around on them and state the original one they hold must therefore be fraudulent ha ha :rotfl:LBM MAY 2009 :T

I thought I'd share my good news that one of my biggest creditors, Marbles, have agreed to accept my DMP payments for a year and freeze interest :j I plucked up the courage to call them myself and they were ok with everything phew, that's a big weight off my mind as they were charging £150 a month in interest and charges. Now it just seems like Egg are going to be awkward as I've had a letter that the account will be transferred to a DCA so I'm going into unknown territory and I'm dreading the calls :eek:0 -

Good news re Marbles, with regards to DCA I could be totally wrong here as you're way ahead of me, but usually they stop the interest etc and tend to be easier to negotiate with re reduced pmts, but please dont hold me to that:DLBM MAY 2009 :T

Hopefully they'll be ok but I have a tendency to think of the worst case scenario all the time and imagining all sorts of horrors0
