I was just interested to hear your full story re CCA's as it does seem a really complex issue. I had problems with CCCS before when I complained about Halifax charging stupid amounts of interest and I wanted to cut them out of our DMP and just pay them a £1 or take OH for ccj. They said no they couldn't favour creditors over the others, had we thought about bankruptcy?:eek: Yeah well if we did we wouldn't be messing with DMP payments every month would we? .:mad: I think they are snowed under, they were advertising jobs in their Leeds department on their websites which just shows how much brown stuff the average joe is in. Also they are connected with the creditors in some way which makes them bias to treat creditors fairly I think.
I just didn't like the fact that it is our debt, we should be able to choose who we should pay and if the creditors aren't going to play nice like the others then sod them! OH thinks just stick to CCCS, its less hassle and he's right I suppose but I just don't like the feeling of the creditors having the last laugh and taking us for every last penny.:mad: It's over, the credit rating has gone, we don't give two hoots about our credit history no more we'll never want credit again after this, dear lesson but one worth learning from. We want to pay what we had back but some are just taking the mick adding more and more on. :mad: I would go it alone but just staring out I felt vulnerable and scared plus I don't have a cheque book with my account.
I have had to SAR all our creditors for our fight for ppi reclaims and its interesting to see just what creditors have got on you isn't it?
Monument sent exactly like you have received - the signed application form and a set of printed terms and conditions. Barclaycard only sent a set of statements. Capital One sent me a CCA with NO signature on at all on the back of a letter addressed to me saying please find the terms and conditions overleaf
I have sent Halifax credit card a CCA request because they are now charging reduced interest and have added a few hundred to the debt since we started on this journey plus OH had letters from Moorcroft who like 1st Credit are noobs when it comes to being tactful, respectful of the rules and following proper guidelines. Now if they don't come up with the CCA, then they had no right to pass OH details on to Moorcroft in the first place. So ding ding ready for that one.
Interesting to see that even the creditors don't fully understand what a proper signed executed agreement looks like either. I have found that some people on this forum like to take the high ground against others when it comes to stopping payments however I think its down to personal choice and circumstances. We have no qualms paying what we owe but be fair otherwise we'll have to consider going it alone and stop paying if you can't produce that vital bit of paper. :rolleyes: That isn't being sneaky, its using the law against the greedy noobs who are trying to make your life a misery.

I know what you mean about some people taking the moral high ground when it comes to having some, if not all of your debt wiped out just by studying the law and exploiting where the creditors have gone wrong. After all, it's their fault, the banks I mean, why this country has gone to the wall!
My question would be - If I could give you a magic bean (or flawed CCA agreement in this case:D ) and it would clear all of your debt and you would be debt free, how many people who claim to disagree with this method of tactics would say "no thank you", i like being in debt and will continue the way I am??????????

Thought i pop in before i head out to footy with the kids!!
Cocker.......i understand where you are coming from regarding the fee paying dmp companys but...i now see that what they were doing is wrong!! They were very good at telling me what i wanted to hear..yes i could call them whenever and for whatever reason, i sent them original copys of everything for them to deal with ..........BUT since iv changed over to payplan which has only taken me 3 weeks to do so, i have only had to pay the crediots myself once on 1st Feb and payplan take over from 1st March, i have found out from 2 crediotrs that had started applying interst that it was because my old dmp company had not been in touch or sent upto date info which they told me they had, i told these creditors i was swapping to payplan and they told me that interest would be stopped again once they recived details from payplan.
Also payplan only ask for copys of statments not originals which i am more comfortable with, and in under 2 weeks i have now got an online record of everything via payplans justabank website, i can see ballances, amount to be paid, if creditors have agreed or contact letters that have been sent all in one place.something i never got with the fee paying company..infact all i got from them was a statment of who they had paid each month.
In the 3 yrs i have been with them i paid out over £2500 in fees alone..money which could have been paid of my debt an i would have been debt free a year earlier!!!
I have reclaimed bank charges whilst in a dmp and didnt inform the dmp company at the time, got all charges back and all creditors still carried on agreeing with dmp.
You said your fee paying company `do as you tell them`...i think this is more they let you think they are doing what you tell them because they dont want to upset you and lose their monthy fee...the fee paying companys are in this to make money not to help you get out of debt...payplan have been great and although they are snowed under i think 3 weeks from first contact them to everything bein sorted and now just waiting for my first payment is very very good.

Just read about a weeks worth of threads.....they certainly build up if you don't read them daily. !!
Its good to hear everyone being so positive about DMP's.. On the whole its the best thing that we have done, and dont regret it at all. What was the option.....to go on as we were would have been financially suicidal,:eek: continuously using cc to fund our day to day living. Its not like we live the "high life"...we dont at all. We have no one to blame but ourselves for getting in this mess and we WILL get out of it.........but I am having a ' low ' day. ! We have our first review on Friday, and we have to reduce our payments, no matter how I try and juggle the figures, we can't continue to pay the same amount. OH has gone on to 4 day week and I am on reduced hours, so its not of our making.:mad: Things just seem to settle down and I know that next week, when our creditors get a new SOA and see that we are offering lower payments, then the phone calls will start again. !:mad:
We have been hassle free for about 5 months and I don't relish it starting again......I am sure that its not just me that feels like this occasionally.......I tell myself that we are both healthy, and can continue working for at least 7 years. ( We are both in our late 50's). but we wanted to get this debt paid off and get some savings put aside for our retirement. So anyone reading this if you are younger than me, let this be a warning to you.....get your debts paid off before your 50's......

Morning all I haven't been on here for a while.
I have had a letter from EGG back in Jan to say that they have terminated my egg card. The letter also says that they are passing my debt to a DCA and that they will be in touch within ten days. It does not say which one though. It has been over ten days now and no one have wrote to me. I have had a couple of strange phone calls though who can't say my name correctly so I have said that no one is here by that name. (I have caller display and it says NUMBER on it ) I have paid egg in feb. Egg put me onto a payment plan for 12 months on that it not due to be reviewed till dec 09.
