  • I remember saying a few days ago that I was just going to stick to this thread as I was reading too many others and getting myself into a panic unnecessarily, well guess what I've just been reading the thread regards NR selling a house for 55k less than what it is worth, and I'm now worrying all over again about charging orders:eek: .
    Apparently, according to the thread NR all the worst creditor to deal with!:(

    Why do I keep beating myself up over all this?:confused:

    One day everything is hunky dorey and the next I feel as though I'm making the biggest mistake of our lives!

  • Totally new to everything posting the lot. Been hovering for about 3 weeks anyway here I am, our DMP also starts on 1/3/09 - at the moment not many questions thanks to you guys more or less covering everything I wanted to ask but no doubt in the future Ill be asking loads, PS Im also a member of the 10 years + club.

    Hell yeah we can drink, though just tea for me tonight as I need an early night in order to get up for a bike ride in the morning. Shift change is at 10pm, right?

    Wanted to ask how you were getting on with the CCA bit? I still consider myself a novice on all this debt busting stuff and get confused over the rules as there is just so much to take in!

    What I wanted to ask was, why you are asking for CCA's and what will you do with them being on a DMP?

    I'm sure no DMP company will let you pick and choose who to pay even if the creditor being complete aholes to you. :mad:

    Are you going it alone then?

    Hiya!

    It's not going too bad really!

    I decided to start asking for CCA's from the creditors who were not accepting the DMP and thretening to take me to court. Namely LLoyds TSB and 1st Credit DCA, who bought the debt from my Morgan Stanley (Goldfish) credit card.

    1st Credit have never accepted the DMP and were thretening all sorts of nasty things including bankruptcy and charging orders. Search for them and you will see how nasty they are!:mad:
    Lloyds TSB did accept the DMP for 12 month, but then stopped and started adding late payment fees again!:confused:

    I'd started looking into CCA's after hearing all them adverts on the radio about having all your debt wiped out due to unenforceable credit agreeemnts. The thing is you can do it all yourself if you know where to look for advice and guideance.

    Both these companies were sent CCA requests in October last year and both have failed to provide an enforceable agreement. Lloyds just never responded to the request, so after several reminders, I removed them from my DMP and told them that I wouldn't restart payments until they produced the CCA. Finally received a letter of appology recently and appartently they are looking into my complaint. Not heard anything since, but I got an alert from Experian that my credit file had had a major shift in payment history. According to them, the account is now "settled" and the balance is zero! Not bad considering last month it was over £6500 and I haven't paid them anything since then. Not counting my chickens yet though as Lloyds TSB haven't confirmed anything in writing to me, however it has been known for them to just cancel accounts and not inform the account holder, so.............

    1st Credit keep sending me an edited version of my aplication form from Morgan Stanley. They rekon that is all they need to send me, but they are just full of !"£$%. I've had a few people look at it and they rekon it is unenforceable as it doesn't contain all the perscribed terms of a credit agreement.

    I'm still paying them though as they are ruthless. The thing is though there is a ppi policy attached to this account and if reclaimed could clear the vast majority of the balance!

    To date they have not attemped to take me to court because they know very well that if they did, the case would be thrown out and possibly made irredeemable unenforceable, due to many errors and breeches of the rules on their part.

    In response to your question about my DMP company agreeing to this. They have no choice as it is a private firm who I pay for there services. They do as I tell them and they dont argue.;)

    I get lots of perks from being a client of theirs, including free legal protection for my car insurance, so I dont need to include it in my actual car insurance policies. I know I pay them a fee to them, but these benefits cut my monthly costs in other areas. Also, they do a great job and I can contact them whenever I want, plus CCCS and Payplan are just completely snowed under with work. However after reading DLB's recent posts I've been chewing over ditching them, but like you say, would CCCS or Payplan like me challenging my creditors. I know CCCS dont like you asking for CCA's.
