I could not agree more. Why can't the government get on with banning the activities, including clamping and towing. Who will run the appeal process? How will it be enforced? Certainly not the BPA who consistently fail to regulate their own members!0
-
I saw the BPA interview and am also disgusted that the Govt solution to this is to introduce an appeals procedure! All this does is legitimise the largely illegal charges which are being levied.
Govt should state there are civil remedies for trespass and if the landowner wants compensation they should use them. They frighten people by copying official PCN documentation, threatening debt collectors, CCJs etc etc. The directors of any company doing so so should be arrested for obtaning money by deception - that may have an effect, but of course the prisons are full!
Totally agree - why is the Government trying to regulate appeals against unlawful threats?
What can we do about this joke of planned legislation?? Lobby our MPs?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Surely brown & co are getting themselves very deep in a quagmire. The only people who will benefit will be the lawyers imho. Mixing legislation with private contract law would create more problems than it solves.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I've been lobbying my MP for several years. He has obtained answers from the Home Office and the Department for Transport. These have done nothing but justify their position.
The DVLA publish a list of 52 companies who have electronic access to the registered keeper database. Many who issue private PCN's
Like Vehicle Control Solutions who run 'Flashpark'. Their website gives examples of issuing tickets for yellow line or Red Route infringements...! This outfit has had to remove its page of 'Approved Clients' and also its use of govt. logos from its home page. But it still uses the BPA 'Approved Operator' logo, which the DVLA says is necessary for electronic link.......!0 -
Got a ticket today and my wife just wanted to pay and get it over with. Meanwhile all I could think of was to get back home and check the MSE forums. So here I am ready to start ignoring the Britannia Parking chain letters which are sure to come. Hope my bottle doesn't go but I know where to come if I need any reassurance to stick with it. Wish me luck

Britannia seem more civilised than some of the PPCs we see mentioned here, I got a "penalty charge" from them for displaying a valid ticket and they followed up with two letters via post before deciding to leave me alone.
I get the impression they are less troublesome than some. But you must still tell your OH to ignore the letters, tonyatglend, it's still a scam but maybe with a more softly-softly approach!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No, it's the fact that people are now reading the stickie at the top of the forum or actually being ar5ed to do a search before posting the same old 'I got a PCN in ASDA car park, what should I do?'
Hey BFG, what exactly is your problem with the world that you have to sit on these forums for hours on end, at all times of day and night offering nothing but cynicsm, put downs and general wiseguy abuse.
Bet you're not like this in the 'real' world with 'real' people, you'd be getting b i t c h slapped all day long, safe in the online 'anonymous' world though eh
Now remember, the forums are here for help and advice for people from all walks of life, if it's upsetting you that much, take a break from it all and reasess your life and it's purpose
Aim that angry, childlike and petulant energy into a useful channel such as clearing snow off OAP paths in these troubled times.
Perhaps a poll for forum members to actually pass jusgement on your smug self perceived 'value' to these forums may be appropriate - whaddya think wiseguy.
Grow up sunshine - for yours and everybody elses sake.******************************************

Hey Doncha....
Get to the back of the queue.
I've got a lot of better stalkers than you.
I love the idea you're complaining at me when you're the one hiding behind a 'fresh' id just to stalk me with.
Try the following.....
cynicism...not your attempt - cynicsm
eh. ... not your attempt - eh
its purpose...not your attempt - it's purpose
OAP paths ...is that paths made of OAPs or paths exclusively for OAPs [like cycle paths]
judgement....not your attempt - jusgement
wiseguy? ...since you're asking a question
everybody else's....not your attempt - elses.
Oh, and minute...not your attempt minue
Still, keep trying and you might get that GCSE one day [but probably not].0 -
Hi
I received a private parking "fine" the other day and want to know what to do about it. All of the advice I read is about unfair tickets or tickets that were given out wrongly. My story is a little different.
At the end of last year I parked in a previously free car park on a Sunday morning for 17 minutes. This was on the day of the terrible snow so the car park was deserted save for myself and one other car. I assumed that being a Sunday, parking was free. However I have since learnt that it costs 50p for the whole day. Because of the weather and the time I presumed that there was no way a warden would be working when the car park was so empty so I didn't bother to check if parking was free. Unfortunately I have been done by one of those CCTV "Ghost" tickets.
So what should I do? If this was a Public Fine I wouldn't have a leg to stand on legally as there are signs saying what it costs to park there. However I do think that it is grossly unfair to charge someone £60 to park in an empty car park for 17 minutes.
One more thing, the car is registered in my wife's name so the penalty is issued to her yet I was driving. Should I go down the route of getting my wife to state she wasn't driving and is not obliged to reveal who was?
Thank you for your time.0
