    We have just had a letter from Debt Recovery Plus, acting on behalf of National Clamps. This is the 3rd lot of communication and it states much the same as the one shown above. It does state that they operate in accordance with the BPA approved operators scheme though, is that an issue, are they more entitled to go down this route?

    They are asking for us to tell them who the driver was or they will continue to pursue the reg keeper. The reg keeper was not the driver and can prove this if necessary. They are stating they will apply for a CC judgement and if sucessful this will lead to attachment of earnings, bailiffs, etc.

    I am assuming that as the reg keeper was not the driver they cannot pursue them for this issue, and if it went to court it could be defended on that basis?

    They also state that they will pursue this amd that a selection of their sucessfully obtained judgements can be viewed at www.drpl.co.uk

    Does anyone have any info on whether these are bone fide cases?

    We have had no contact with them at all to date, just ignored the letters. Is it really safe to ignore this one too?

    Being a member of a trade association does not bestow upon them any special rights

    They may well be but may have nothing to do with parking invoices

    Have you posted the pcn previously or does it state it is a private company and is it a penalty not a fine?

    Thanks for that both of you.....it is just a bt unsettling to get these quite threatening and intimidatory letters, if they have no basis to enforce them. I really dont know how they get away with it.

    It was a piece of land behind a shop, and it was a private clamping company called National Clamps, not a council/police issued ticket.

    It was a penalty notice.

    The driver was actually in the car with the engine running, whilst another person popped into a shop, and the operative slapped the ticket on the windscreen:mad: without speaking to the driver.

    Look upon them as a source of amusement, every time they send you one it costs them money, when they stop sending them just go park diagonally across a few bays in your local supermarket to extend your fun, swap them with friends, a special treat is if they send you a prepaid envelope to return your "payment" pop someone elses crap in the envelope and send it back, double glazing leaflets, bettaware/avon catalogue, your local takeaway menu you get the idea. Bonus two lots of postage and you get rid of your doorstep drops to boot.

    Sounds like a nice guy. Would have thought easily challenged too, depenant on the definition of parking, I have always understood that the vehicle must be empty of occupants to be classed as parked, if occupied it is considered merely stopped and only subject to stopping restrictions unless a loading bay but I'm not really that clued up. Who cares either way they are stuffed.

    It is not a Penalty Notice.

    Do not challenge it, merely ignore it while keeping it safely at home.

    ben500 is mistaken - the key word is waiting and the occupants make no difference at all. But that is only relevant to real council PCNs.
