    In a word NO. See my reply above regarding "disabled" bays in private car parks.They have no standing in law. The car parking company have no right to "fine" or demand money from anyone. Just read this thread for more information. Don't worry about "court action". The only court they can take you to is the Count Court where they have to prove they have suffered a material loss. Just by parking in the "wrong" bay they have not suffered any loss.

    In fact, in this case, the vehicle wasn't even parked in the "wrong" bay. The driver had good reason to park there.

    The "warden" did you a favour in this case - you might have used the badge in a real disabled bay, and found yourself with a proper ticket.

    Just ignore. You will receive more letters, but just file them away, and they'll move on to another victim soon.

    My partner had his car clamped and towed away within an hour of the clamp being placed in Leeds on a night time.

    We was going out for a cheap meal and he parked on a private street between some apartments, yes there were signs up but he didnt think that this meant the spot he was in.

    Anyway he came back to the car about 11:45 pm and the car wasnt there he rang the company who said the car had been towed away, they clamped it first and because he hadnt returned in an hour towed it away!

    He wasnt allowed to know where the car was, they wouldnt tell him, he had to wait till the morning to ring the office and arrange payment.

    He was told the fees would be £500, not to mention the taxis into town and back that night!!

    He was also told that its £50 each day it is in the compound! They added a total of 2 days worth even though the car was only in compound for about 12 hours! From about 10pm at night to the same time next morning but they charged 2 days worth!

    Totally discusting and a very expensive night, these people are criminals!

    if that had been me I wouldnt have been able to afford the fees and my car would have been destroyed.

    These people need shutting down!!!


    What should my partner do now, obv he had to pay!

    As i know a lot of you have said about not paying etc if its a private company, today i recieved a letter from a solicitors (trethowens) requesting payment for a charge notice i recieved when i parked in a train station car park. Now, i saw the people doing it, they definately weren't cowboys, there were 3 of them walking around in police like uniforms and their high visabilty stab vests (they definately weren't police though as they had the name of the company on their clothing which was CP Plus ltd).

    Now i know the land is private, but this letter had requested payment within 14 days of the letter dated. If they don't recieve, as they put it, there client will proceed with court proceedings without notice.

    It does say that if i wasnt the driver i must provide details of who it was (even though i was the driver) so i know in one way they probebly are not taking into consideration that i know i dont have to provide that info (correct me if im wrong).

    I just want to make sure that i can ignore these letters and hope that they will then cease to contact me again. The letter does state that the company is a member of the "british parking association's approved operator scheme" if that makes any difference?

    I know this will seem like every other instance raised on here but like everyone else i want to be sure that i have a case if or not a case as such and can ignore these in the hope that they will not follow through with it???

    vdubber86 - Does the ticket make any reference to byelaws, i.e. railway byelaws? If not, then treat as any other private ticket. It is irrelevant that they are a member of the BPA's scheme, the BPA is simply a trade body that represents these cowboys & acts in their interests (see Martin's blog for more).

    Vdubber its probably too late now but I suggest you remove all references as to who was driving. Never admit this on any contact or on forums, its not unknown for ppc's to trawl the forums looking for easy prey.

  • No there's no byelaws, and yes thats the company that have given me the ticket on behalf of the train station. They were dressed exactly like that walking around with there electronic machines.

    I'm not going to say that i wasn't driving but, just stating that the solicitors were saying i must tell them who was driving if it wasn't me, which, i know i am completely in my rights not to tell them, i sign to me that they are threatening people without substance

    My problem seems a bit different. I have been clamped a few times by the company that runs my housing association car park. Now we have been issued with parking permits which we are supposed to put on our cars. Now i have a few questions for in case I get clamped and towed the next time.

    1: If my parking sticker fell from the dashboard onto the floor and I am able to point this out before the car gets towed, do I still have to pay the fine?

    2: If question number one occurs but the car has already been towed, what rights do I have?

    3: One of the housing association rules is that cars have to be taxed and insured. Where the DVLA gives two weeks grace before tax is renewed, is it legal for my car to be clamped and towed if I choose to exercise this two weeks grace.

    4: And is such a rule legal(que 3) since I might want to sell the car and may have not found a buyer yet that the car park management company would just take my car for free.

    5: When a car is towed from our car park, it incurs a charge of £40 a day till you have paid the fine. I should think there are many laws that this contravenes. Can anyone help me with a few of those.

    6: After an accident, my car was in the garage for repairs so I was using a courtesy car. Shouldn't a note on my screen be enough not to get my car clamped and towed. Since the housing association takes a few days to issue a visitors parking permit for the courtesy car, that I will only be using for a day or two.

    7: What to do when your car gets clamped at 7:00am on the first of september for example when your parking permit expired on the 31st of August.

    I need some help here people. And not just me but all of my neighbours except one who's parents work for the housing association in question
