I have been issued a charge for parking in a "private car park" by UKPC, I am a type 1 diabetic and felt my blood sugars getting a bit low so I parked up my car in a responsible manner so to avoid an accident and went to a shop round the corner to get a coke and twix and prevent my blood sugars dropping further, this was at 8pm and I was about 30 minutes.
I have written to them stating that I was in the process of dealing with a hypoglycemic attack and have sent a doctors letter to confirm but they still want me to pay the £50 fine. Surely if this is a contractual matter then I was not in a fit state to enter into a contract? I didnt see any signs and just presumed that at 8pm it would not matter as the company whos land I had parked on were closed.
Does anyone know anything about this? Should I just pay?

just to update you on this, since the aforementioned letter, i got other letters on:
3/9 - get in touch in 7 days else we'll pass the matter on to graham white
16/9 - notice of intended legal action from GH. basically a 'if you don't pay in 14 days we'll put all these additional costs on (making £207.25)
4/10 - final warning from GH. basically a 'pay us immediately or we'll refer the matter in 7 days'.
WELL BL**DY DO IT THEN! :rotfl:

Please Please Please can some one give me some good advice....I recieved a charge notice 2nd Feb 2011 regarding parking on the 31/01/2011, I replied back saying I was not the driver but sent it to the appeals section, I then got a reply on the 08/02/2011 regarding me sending a standard letter and that there was no reference to any mitigating circumstances, they would not be accepting this as an appeal please send the name and address of the driver within 7 days, my reply stated that I was not appealing and my letter was sent to the appeals section by error, it does not state an appeal it stated that I would not be paying your demand and that I am in no obligation to disclose who was driving the car, so please do not contact me. I then received a reminder notice not to ignore on the 17/02/2011 and now I have recieved a Legal Action Pending dated 04/03/2011, my bill is now £120...........is it likly that this will be going to court and what do I need??? should I send them one more letter stating that I was not the driver, where is your evidence or more like can you prove it was me with your photographic evidence, you really harrasing me now??? any info would be much appreciated I have actually woke up today thinking I'm going to court but to be honest I have so much to do we are under so much stress at present that I could really do with out this.......I sent it to the appeals in error and am I really going to have to state who the driver was as they have asked the question0

My first piece of advice is to read post 3066, just above yours and start your own topic. See top left box that says New Topic. There are so many on this thread yours could easily get lost.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

They won't take you to court, it won't blacken your credit rating, it won't go any further than junk mail.
Understand that the invoice is unenforceable, cease all contact with them, the appeals are a sham, they turn down all attempts of not paying.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
