CIVIL ENFORCEMENT AND NEWLYN

Just to say I've now had an 8th letter from Civil Enforcement/Newlyn BUT letter 7 was a repeat of letter 3 and letter 8 was a repeat of letter 4. They appear to be going round in circles rather than just giving up!

I shall be posting the above several times a day randomly...this will hopefully co-incide with the same question being asked several times a day randomly.

I would suggest that if we all posted the same response all the time we would have less repeat questions [but then again this is t'internet, lol].

Or they are going round in circles rather than actually doing something in the way of courts. Thus proving most things are just empty threats.

I'd love to know what the record is for the number of "final" letters someone has received :rotfl:

Yes I've had letter no. 8 from them too - and like you it's a repeat, as was letter no. 7.

Ah well at least we're costing them paper, ink and postage. And the time of the person who has to stuff this rubbish in an envelope;)

I have been issued a charge for parking in a "private car park" by UKPC, I am a type 1 diabetic and felt my blood sugars getting a bit low so I parked up my car in a responsible manner so to avoid an accident and went to a shop round the corner to get a coke and twix and prevent my blood sugars dropping further, this was at 8pm and I was about 30 minutes.

I have written to them stating that I was in the process of dealing with a hypoglycemic attack and have sent a doctors letter to confirm but they still want me to pay the £50 fine. Surely if this is a contractual matter then I was not in a fit state to enter into a contract? I didnt see any signs and just presumed that at 8pm it would not matter as the company whos land I had parked on were closed.

Does anyone know anything about this? Should I just pay?

Several people on here (including myself) are now advising that people who have been subject to the "PPC experience" should complain to the shop-keepers and other occupiers of places where PPCs operate. These kind of letters cause immense distress and had I not been vigilant in keeping my fuel receipts, I could have easily been an elderly or vulnerable person who would have worried themselves sick over this and paid up. It is totally scandalous that the letter implies legal action and having a debt registered against me. I do not believe this to be even a lawful practice as no offence has taken place and there is no contract or credit agreement. I am furious that they have gone to DVLA to gain my driver details on the basis of a faulty camera? I am keen to know how and why you allow such letters to go out given that it is your company name which is implicated in this.

I am truly disgusted at this and that you employ such unscrupulous agents with equipment which is clearly not fit for purpose.

There is a legal time limit of requesting information from DVLA which must be done within 28 days. Amazingly this reminder notice was printed on the 28th day and having not received an initial letter, I also believe this to be in contradiction of the code of conduct. I believe there to be a misue of my personal data and DVLA records and will inform them so.

How many other people have potentially been stung by these letters? How many people have potentially paid up out of fear?

I am sorry, but this is a disgrace and even though it is private land, there is no legislation to parking on it and nor can you enforce such penalties in court. Your business operates and needs vehicles parking on your premises and if this is the repayment I get for being a repeat customer (and also my business) then you should be keeping a closer eye on such a charlaton company who represent you.

I would details of your head office and name of a senior manager if you could kindly send it to me.

People like CP PLUS ought to be ashamed of themselves and so should Moto for employing them. They deserve no sympathy and the more that people complain about their unlawful practices, the sooner we shall see an end to such disgusting tactics on innocent drivers.
