  • PPCs carefully wait until they think that they have the ideal material for legal action. Perky did it with Thomas and possibly the Telford case. Excel made a serious error of judgement with Hetherington. For all their bluster, PPCs do not stand a snowball in hell's chance of winning when they do not know who the driver was and the action is defended.

  • Possibly but Thomas did himself no favour by being easily identifiable on an internet forum providing Perky with useful evidence. Once in a while a PPC smells blood and this could have been such an instance.

  • Trading standards, are they the ones who recommend paying then appealing? or is that CAB.
    Police? "Well its a civil offence sir " this is the stock reply even when blatent theft has taken place, just read up on the LBS thread. To be fair LBS have been taken down by the BIB but they are a very rare case.
    CAB spout the nonsense they are told by the 'impartial' BPA such as appealing or paying up. The advice given by Consumer Direct is often just as dire. Mind you, plod fares no better.

    Out of curiosity, if these companies don't take people to court, how come Excel seems to have done just that, albeit back in 2008?

    I had a 'ticket' from Civil Enforcement Ltd in September and I have now had all six letters from them and Newlyn. I'm gutted that I won't be hearing any more from them or has someone had further letters that haven't been photocopied on here?


    They sometimes take people to court if they think they have a case. It is normally because somebody appeals, and starts the letter off with. "I parked my car" then says "I did not read the signs". By doing so you have taken away two things they would have to prove!
    The only argument then is the unfair contract, and the penalty.

    In the often quoted Thomas case, the pillock was posting on a website admitted he was the driver and that he always parked there.

    If you ignore them from the outset it is impossible for them to issue proceedings as they have to establish who the driver was. You will always get the odd PPC who fancies their chances but it is a minuscule percentage!
  • Thanks esmerobbo - that makes it perfectly clear. I have had absolutely no contact with Civil Enforcement or Newlyn so they probably won't come after me. I did wonder what the Thomas case was. My husband also got a 'ticket' from APCOA when going to luton airport - I told him to ignore it but the person who was driving wrote to appeal so now they know who the driver is and what the circumstances were. Is it still safe for him to ignore or have they got grounds for chasing?

    Still ignore! It is easier for them to move on to the next mug, then to try and enforce. Even if they did obtain an order from a county court it would probably cost them more to do it in time spent on the case, which could otherwise be used intimidating someone who does not know that they should be ignored!

    Then he lied to the judge by saying he wasn't the driver, handing victory to Perky.
    No wonder some people think it was a set-up!

    Click the link on my signature, settle down and read some threads for a few hours. You will soon learn there's nothing to worry about with either scenario.

    You WILL almost certainly get letters from the PPC and the debt collectors. So what?:rotfl:

    Ignore it all from now on, ensure the Luton Airport driver sees the letters in our sticky.

  • 2 letters from Parking Eye dropped on the mat this morning first one saying my Appeal was unsuccessful because I haven't sent in the relevent infomation ie......... no copy of my disabled blue badge and a copy of a shop receipt saying I was still shopping at the over stayed time of 3 hours ..........

    2nd letter is actually a letter with 2 photo's of the car front and rear taken from quite high up and I can actually see myself in the passenger seat !

    Can anyone tell me what the next cause of action is ............Hubby says "on my head be it" lol if I don't do anything
