I'v just had a Parking charge notice from excel for parking in a retail park car park which there is no charge but I did'nt realise there was a maximum time limit of 1 1/2 hrs which I went over. The thing is this happened on 16/08/10 but i have just recieved the parking charge notice today 16/09/10 which is exactly 1 month ago. Is there a maximum amount of days to which they have to send the notice out?
And do I have grounds for appeal?
    Cheers Stean
    Welcome to the forum:)

Parking Charge Notices are legally unenforcable because they are scams not charges or fines. You can safely ignore them no matter how legal they sound; they are empty threats, and to date, no private parking company has successfully enforced a parking charge notice in court; its all a big scam. Don't be intimidated by letters threatening with court action; they are all empty threats in the hope you will pay up. Stand your ground and don't pay, no matter what!!!
    If it moves; sue it!

You could try this, its a bit rude.

    F
    urther to your letter,
Understandably, i will not be paying this sum.
Charges such as yours cannot be made without certain condisions being met
Kindly supply me with evidence of who was driving

Of course, I will also need evidence that this driver entered into a contract with you
Further, I need details of the nature of this contract
For the avoidance of doubt, I shall make a few things clear:

Such sums are not generally accepted as lawful
Contracts must be proven, and fair
As such, your charge has no legal basis
Many court cases back up my assertations
My money will not be given to you
Every letter you send to me will waste more of your money
    Regards,
Someone who knows how your little scam works.

I love this letter - I shall use that one day when I get another bogus parking ticket! :T:T

Please all you newbies, if you dare, send that letter off (all it will cost is a 2nd class stamp!).

If not then ignore your parking charge notices or make paper aeroplanes from them, as shown on Watchdog earlier this year:

DON'T PAY A PRIVATE PARKING TICKET - THEY ARE SO SIMPLE TO IGNORE!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Got to admit it came from the other side, I'm sure they won't mind me nicking it..

Some interesting cases over the last year with regards to harassment from companies and their debt collectors. We have:

    • British Gas - £5000 awarded against them
    • nPower - £3000 awarded against them
    • UKPAO - £1000 awarded against them

Obviously the last of one is of interest. Supermarkets will be a lot less willing to employ these clowns when they are having to pay out thousands in compensation if people start bringing county court cases against the likes of Sainsburys.

The CAG forum is reporting yet another case lost by OPC. This time it was in Wolverhampton, and the case was lost because they could not prove the identity of the driver.

This point is also pertinent to another thread, where a disabled driver was told by UKCPS that they would be "made to tell the judge the identity of the driver".

Thanks so much to all the great advice on here. One thing I'd like to know is, i these companies are just a load of scammers and cant actually enforce any 'charge' under our laws, what's the point of them? It's like police officers that can't actually arrest anybody - what use are they?

Because about 30% of their victims believe their lies and pay up.

Oh dear! This is very close to Perky's stamping grounds. Do you think we'll see an increase in trolling for the next couple of days?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

If someone threatened you and said hand over your money, then many people would do just that.

Sadly many people are ill-informed as to the legality of the situation and don't realise that these scum are no more than er...scum.

Where do you get the 30% figure from??
