  • I am in a right pickle here with PCN I received or should I say did not receive.

    On the 13 July 10 I received a letter from Ealing Council saying that they issued me with a PCN on the 03 July 2010 and that I was to pay £100.

    I wrote back and said that I never received the PCN that they issued on the 03 July 2010 and asked them to send a copy or proof.

    Today I received this letter and I am really quite angry as I did not receive any PCN and now face court action for a CCJ and have to pay £150. Please could someone advise what I should do as I am so confused.

    If you refer to other threads, you will see that Roxburghe do like to give the odd friendly phone call and after that someone may well call on behalf of Graham White solicitors.

    thanks shortchanged. i've just noticed a post on previous page re another company that also use Roxburghe (or Rox 'bother' as we should call them!), where the reply to the post states that Graham White call up pretending to be Roxbother. I will tell my family to ignore their calls. A new company has now taken over the running of my work car park so i'm sure i'll have fun with them - anyone heard of 'parking control services'? According to the Ts & Cs sent by my company to all staff state they 'reserve the right to clamp any vehicle that has failed to pay a Parking Contravention Charge notice within 28 days of issue'. Looking at some consumer website I found on google, they WILL actually clamp which is a little unnerving...

    Completely illegal to clamp a vehicle for a past private parking ticket, also as clamping is soon to be gone thank god, not that I ever been clamped , but If I found one on my vehicle it would be removed by the tools I carry for my job ;)
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    lol. well i'm not sure many of us staff will be going to work with bolt cutters (i dnt even own any!). now we can't even not pay the fines w/out our cars being clamped! what's our strategy now??

    Why can't you not pay ? Really the tickets are unenforceable in law, and your company cannot force you to pay these tickets, I would check your contract of employment and if you are in a union check with them.

    My understanding is that if your company tries to deduct money from your wages, it could be an illegal deduction, you got to understand that clamping a vehicle for a past ticket is completely illegal.

    So are they issuing permits or something for staff ?

    Yes you can! Don't even think about giving in to this blackmail!

    You can ignore those signs as the threat is illegal, they cannot lawfully clamp for any alleged unpaid debt. It would be a shame if someone spray painted those signs black wouldn't it, shame that's unlikely to happen...

    How about this action:

    Report them to Trading Standards for a start - make it clear what the signs say and point out that clamping for that reason isn't legal. Don't take the word of the first clerk who answers and says something rubbish like 'clamping's not illegal yet' (you may have to jump through the hoops of the Consumer Direct call centre to get to a proper Trading Standards person!). Spell it out to them and insist that they need to investigate the clamping firm.

    Report them to your MP (same reasoning as above = illegal to clamp for an alleged debt, the only remedy to recover an alleged debt is the County Court).

    Tell the local press, saying same as above.

    Complain to your employer. What are they doing allowing scum like that on the land, especially with the whole protection racket having been exposed by the Government as an uncontrollable scam, and lined up for becoming a criminal offence very soon?

    They sometimes call pretending to be Graham Whites 'Solicitors'. You'll probably receive 3 letters from them anyway, before they give up.

    If anyone calls just tell em to !!!! off.
