    Norwich Pharmacal orders

    A Norwich Pharmacal order is a procedure whereby it is possible to find out the identity of an alleged wrongdoer. The principle originates from the case of Norwich Pharmacal Co v Customs and Excise Commissioners [1974]AC 133, 175, HL.

    As there was no wrongdoing taking place it is of course mere bluster on the part of these pathetic idiots.

    I too do not understand why Martin's "official" advice has not been to ignore all and any communication from these scum as it is by far the best course of action.

    I speak from experience of having never replied to a PCN, been threatened, lied to and eventually ignored by the dross that they are.

    I have come to the conclusion that threats of a Norwich Pharmacal come from the mind of someone with a distinct absence of the ability to think in any coherent manner.

    Also, by stating that they will knowing take someone to court without first identifying a real defendant they have sealed their own fate. Trust me when I say that a DJ will not be amused by such a declared intent to abuse the court process.

    In receipt of such dross I would welcome them issuing a claim.

    TBH I think MSE M has done us all a dis-service with the advice to 'write and query the amount of the charge without necessarily confirming the driver, blah, blah'. As many have said, once you contact these people they then badger you even more [as they have a confirmed address and 'likely' culprit].

    If you don't reply at all, they don't even know it the RK details are up to date with DVLA so they go away sooner.

    I guess maybe he was relectant to sully Brand MSE [currently worth £1-2million] by offering 'aggressive' or 'fraudulent' or 'prejudiced' or 'direct action' or 'sneaky legal loophole' advice [the quotes marks indicate that the words are how the press might have [wrongly] interpreted it if MSE M had simply said "Ignore, ignore, ignore!!!"]. So I guess it's a difficult one.

    Hopefully anyone reading MSE M's article will get to this thread and see that the best advice is to ignore everything from them [tbh and iirc MSE M does refer to this threads stance; there might even be a link in the article???....can't remember].

  • I parked at Morrisons for just over an 1 hour, then returned and parked for just over 1/2 hour.

    Euro Car Parks issued me with a Parking Charge Notice (your vehicle was parked longer than the maximum period allowed). However the maximum period is 2 hours and in total I was there less than 2 hours. However I did return within the stipulated 3 hours. But that it is different reason on the ticket (the vehicle returned within ? hours of the previous visit) which hasn't been ticked. I'm very annoyed as I returned to buy a thank you card and present for the dentist !

    So what should I do. Write immediately to say I wasn't there longer than the maximum period (due to habit I did park in the same spot) or just ignore as the forum suggests. Of course Euro Parks say an "appeal" takes a minimum of 28 days, by which time the opportunity to pay less (£30 instead of £50) has gone away as a ticket has to be paid within 14 days.

    I can't prove I was only there for 1 hour 30 minutes. I have my receipt for the 2nd visit and I was picking my daughter up from school at 11:30 when they say the car was parked there, which in theory I could ask the school to confirm, but it would be difficult as the school didn't see me pick her up.
