Your point being that if there is a technical infringement in the way the ticket was issued then anyone can park wherever they like and using the pavement as a used car lot is fine with you too.
The vehicle is illegally parked. While you are waiting for the PCN to be posted have a trawl through the Highways Act.
My true colours, which seem to be of a different hue to yours, are that if people commit offences then they should pay the penalty. In this case whether the PCN is up to scratch or not this example of parking is not fine by me.
A responsible driver would not have parked in this manner and I cannot imagine what possessed the OP to publish such an example of obvious illegal parking. If it makes you feel good to try to find a 'get-out' for such crass behaviour then good for you.0 -

Neil, i have scanned the pcn onto my computer and it is held on my desktop in a .rtf file, now im stuck as photobucket cant see it !0 -
scully how did you scan it in? I'm guessing via a word processor/microsoft word if it's in rtf.
There should be a scanner wizard on your computer somewhere. If you use that to scan the PCN, it should ideally save it as a jpg which photobucket will 'see'.0 -

Ideally images should be jpeg - PC should be able to convert.

i have already clearly said that I find footway parking abhorent. Here is where we come to priorities. >>

This may, of course, not be the case but shall we see? i like my Local Authority to act legally and it might surprise you to know that I am actually a supporter of parking enforcement.
Just today I heard of a CEO who was dismissed by a Council for malpractice. The significance being that this is virtually unheard of - and i find that disturbing. Incidentally, a big congratulations to the Council who took that action.
No. People should not park wherever they want or feel like it - but people are entitled to make a mistake and learn along the way whilst councils should be applying the Regs fairly - and I can cite you no end of cases of Council intransigence and misfeasance and even malfeasance. Lets' just get it right and be fair to everybody.

Yes, defeating Councils that operate outside the law, act unreasonably in various other circumstances and there being frequent evidence of them acting intransigently by playing the 'percentage game' of who is likely to pay - yep i take great pleasure in it. Wanna list?
Here's a good deal. there may be nothing wrong with the PCN at all - then you can rejoice. On the other hand there may be legal flaws (credit to scully who has said that is not what he wants - but is all he has at the mo). if thee are any and the Council are acting illegally - then you can respond with a legal way of getting them out of it - ok?

Its like the council putting a ticket on your windscreen when your in the car with no seatbelt on, its not for them to do so.0 -

Although we haven't seen it yet you have probably got contravention code '01' which refers to you contravening the yellow lines - which apply to all of the highway as explained.
