Hi scully - if you right click on the picture of the ticket on your computer and open with "Paint", then draw rectangle boxes or scribble over the relevant personal details, then upload it as you did with above.

The ticket is VERY important to the matter, yes. You can't just assume it's correct.

And the car for sale point is irrelevant. You've got a ticket for double yellows, not for advertising the car for sale.
  • No evidence of double yellow line offence. Bang to rights on parking on a footpath or even obstructing the highway (which includes footpaths) and the police have a power of arrest for that.

    Addendum.

Seem to remember from years back there was some obscure offence of parking within 20mtrs (or something) of a road junction during the hours of darkness.

well the man asked for factual comments and we get inaccuracy again!

Basically scully - wrong place as discussed elsewhere. i'm happy to stay and help to get you through the dross misinformation but it ain't easy mate.

For DD. You correctly noted that the highway includes the footpath - the yellow lines apply to ALL of the highway. someone correctly pointed it out earlier.

Yes, definitely need the PCN but please please please try tinypic so we can see it directlty as i gave you full instructions - including 'Paint' to remove your details.

On your issue of not being able to take it to court - i didn't say that - i only said that a Mag probably least likely to apply. if 'decriminalised' parking then there are avenues of appeal.

That said, from your pics, no chance - so i'm hoping the PCN has something - I need ALL of it!

I suspect you will need to expand on "ALL of it", Neil.

  • Thank you for pointing out my error re the yellow lines including the footpath. Appears that the OP has only been ticketed for the lesser of two offences.

I find it weird that people park in places that they obviously shouldn't and then whine when they get a ticket.

Thanks for clarifying by showing your colours!

So, it would be no problem for you if the Council had issued an entirely illegal document purporting to be a PCN? May not have followed the law of the land in correctly creating the relevant Order for the restriction? May or may not have employed the CEO (or other as appropriate) legally and legitimately in line with the law of our Country. May not follow the procedure set down in legislation for the processing of such a circumstance and any subsequent appeal.

Cos >>>> if that's all ok by you - his parking is ok by me! - and i personally cannot abide pavement parking!

Keep trying - you might get something right in a minute!

Offences - well we don't know yet, not seeing the 'ticket', if it's decriminalised or RTRA 1984.
If decriminalised then in warwick it is highly unlikely there is any contravention of footway parking. Don't know of any Councils outside London who have managed to implement it yet - although a few have indicated they want to - and rightly so.

If RTRA 1984 then 'obstruction' is viable - but still, we don't know - unless i missed it earlier?

If it is decriminalised then no, not the lesser of two contraventions. Both, even if footway parking was included (see above) would be at the same 'higher' level - but only one may be issued.

Can't recall 'sale of goods on a public highway' and certainly not looking it up for your benefit but also 'higher level' i think I recall - so that's three!
in any case, most Councils concede that it was never intended to prevent the advertising of private sales but rather to combat illicit activities of traders.

Why is wherever anyone goes they cant just get direct help !! Thats the problem generally with English people, we spend all day shooting each other instead of helping each other. I have seen cars parked there loads of times before, in fact the whole road has people parking along the pavements and i will add more photos to photobucket later. Please can we stick to the fact i am annoyed that i dont think it is legal what they have done, i got a ticketin my van for parking on double yellows using my disabled badge last week but didnt realise i was in a restricted zone ! Silly me but i paid the fine and didnt complain. YOU mr should be helping me not encouraging the councils to continually rob us and give us illegal tickets thats the point of this now pleaseif you cant offer any assistance then please dont post.
Neil i will try to use the thing you said but i have never used it before so i might have to stick to what Sarah suggested.
