I really hoped when I saw Mobile Outlet's recent responses on this forum that we might get our money back. I thought that this forum had perhaps done what my letters (with wording provided by Trading Standards) and small claims court application had not done: get a positive response.

I e-mailed Mobile Outlet using their special forum email address on Sunday night, and gave them 48 hours to reply. Even when they responded on Monday saying that they would respond in between 24 and 48 hours, I chose to hope. But alas, we have had no response and no money. So much for Mobile Outlet being up-to-date!

I do not know how Mobile Outlet make their decisions as to who to reply to, and whose contracts to honour, but we seem to have been unlucky. Perhaps I should say that when we applied under the small claims track, we did so for the entire 12 month period rather than the 6 month period then due. I did this after consultation with Consumer Direct on the basis that MO had wrongly declared the whole 12 month cash back invalid - so the judgement would put us in the position we should have been in had the whole contract been honoured. MO of course, did not bother to defend.

At this stage, I will now ask Northampton to pass judgement by default and then I will seek to have the judgement enforced. I am concerned about MO's overdue accounts. Perhaps all our problems are caused by cash flow problems. However, I do know that their actions appear to be in breach of contract law. I also wonder whether they have breached other laws.

I am hoping that this message might reach the conscience of MO to act appropriately, but I am not optimistic.
  • Hi Merryal,

We have checked this morning and there is nothing outstanding for Sunday. Can you PM your contact details we can arrange for someone to contact you and resolve this situation.

Over the last 10 days we have been in contact with the majority of customers who were declined incorrectly due to the error in the T's and C's (dispatch note rquest)to proactively resolve the situation. If there are any customers who have not had any contact I would encourage them to email forumqueries@themobileoutlet.co.uk so we can deal with any outstanding issues.

    Regards,
    Forum Query Team

I am delighted to say that we received an e-mail sent 12.48am informing us that the cash back will be sent within the next 5 working days.

Thank you very much, and I will of course let everyone know when we receive the money. Hopefully for us, this situation is now resolved.

    Hi everyone,

I have two contracts with The MO on Three. I did find the T & C's confusing and I did seek clarification from the before I signed up. I actually got a reply from Imran, their Sales & Marketing Director, who explained the proceedure that I should follow. I applied for my first cashback at 6 month's and this came through with no problems. With all the concerns & doubts regarding cashback schemes one can never be totally confident, but so far I am happy with my lot.
  • In reference to my earlier post (107) and their posts on here I contacted MO and cc'd in trading standards outlining that I too had been sent an inappropriate 'refusal' due to no dispatch note said to be caused by their problems with an external supplier.

I was then promised twice that I would receive my cashback imminently. I didn't post anything on here as I wanted to give the full (happy!) story that I had in fact received my cash and that MO are good guys.........

Unfortunately I am still waiting. Come on MO - how are we supposed to give you good feedback if you promise to pay within 3-5 working days and I am still waiting 10 working days later??
  • Hi linzh,

  • After having so much trouble getting cashback from OSPS , i got my July cashback this month. I decided to take out a contract with TMO, my first claim is due to be submitted next week. Fingers crossed it will go smoothly, getting really fed up of the hassle of claiming cashback, thinking of using my 02 sim cards and going back to PAYG.
