Seems that Apple must be under strict legal advice as there are loathe to commit anything in writing... must be time for the legal experts on MSe to take over!
Call them, they were really nice to me. I do agree with your last sentiment though, except for the 'legal experts' bit.

This whole thing stinks, although I did suspect something like this would happen.
Apple clearly don't want to talk about it - it seems the call centre staff have been given a script which they must not deviate from. So if they are not fulfilling these orders, where have the cameras gone? Sitting in Apple's warehouse somewhere? Accidentally been 'destroyed'? When I ordered, they were ready to ship in 24 hours - that implies they were in stock. Their system acknowledged and confirmed my order - I'd have thought no computerised system would sell non-existant stock. Especially not from a reputable brand like Apple!0 -
Time for a legal eagle to submit a subpoena to view their stock records - quick before it turns into another Enron!0

the chap i spoke to also this morning was also very nice ...just doing his job ....but i put money on it that we all get an email in the very near future stating that order is now cancelled .
they would weaken any the legal stance that they have taken and believe they can win with if they allow some orders to go through at a later date..
I doubt that apple will never ever sell the olympus e1 on thier site again.0 -

Just rang them too geting a similar story. Was told they were out of stock and unlikely to fulfil the order.
I then asked about the possibility of keeping the order open incase stock comes in and I was told this wouldn't be possible. I then went on to say this wasn't acceptable, that they've taken my money but told me I can't have the product I ordered, can't have an alternative product and i'd have to wait 3-5 business days for a refund and there was no form of compensation.
I asked her to speak to her team leader to see if anything could be done and she said she will call me back if she has any news...can't really see this happening though.0 -
Not sure if this is relevant.... but it does have a lot of inforation about the formation of contracts....

As a resident legal eagle can I refer to my post some days ago where I explained that, based on their T&C, their only let out was to say that stock was not available.
I can at least claim the satisfaction of being right as this is the line that they are following.
I repeat what I sain in the earlier post. That if sued, it will be expensive and time consuming for them (and the burden of proof will lie on them) to make good this defence.
However, I note that this item has now disappeared from the website which is not encouraging. A quick look at the Amazon website shows the kit of body+lens is discontinued and the body alone as being on back-order.
All in all I would not hold your breath viewed from the legal standpoint.0 -
Just spoken to Consumer Direct. The lady basically said there was nothing that could be done due to their get-out clause in the T&Cs about availability of stock. She said it is misrepresentation on Apple's part, implying the goods were available for shipment within 24 hours, but said there's no way of proving the stock situation. She said they could, and would, probably just make a number of excuses to wriggle out of the situation.0
