What the hell is that all about?
Agree, but it's mainly those who are providing the more negative advice - maybe they feel agrieved for not ordering in the first place. The predominant posters that have thanked the original poster are still trying to get apple to honour the orders.
Or perhaps they work for apple on the legal side!

This was UK right?
If this was the UK price
Total: 84.00
Shipping Cost: 0.00
Discount (Incl. in Total): 425.79
VAT @ 17.50% : 14.70
Order Total: 98.70
and this
Total: 82.00
Shipping Cost: 6.90
Discount (Incl. in Total): 660.98
VAT @ 21.00% : 18.67
Order Total: 107.57 euro btw!
was the Irish price the they surely can't later claim misprice twice if they try to change their defense from No Stock available.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
Just a word of caution for those who might what to play the cost card.As i mentioned in a previous post this was an offer made to a class of persons.Apple may well defend a claim and ask the judge or recorder to make it a class action,in which case, they would need only defend one action. It is a decision thier legal team might consider when they know how many claims are issued.
I am not familiar with small claims procedures or the power that court has but, i know in equity the court will be seeking to right a wrong and not to punish apple.Any posts by myself are my opinion ONLY. They should never be taken as correct or factual without confirmation from a legal professional. All information is given without prejudice or liability.0 -
Apple to me did clearly state it was a misprice before they then changed their mind to a no-stock problem, but because I pointed out that cancelling due to misprice was against T&Cs they then changed their mind to say it was no-stock as that was allowed by their T&Cs. Surely that's an indication that they did have stock.0

Which, to set things to rights, Apple only have to refund any money taken.
Last time this sort of thing happened (I beleive it was a 49p TV) a group of scum (sorry solicitors) were going to fleece punters £20 each so they could send a strongly worded letter to the company concerned hoping they'd immediately fold.
(Just found the Link http://v2.theclaimroom.com/index.lxp?host=246&area=form&form=165
Good old firm of Bevans wanting £20 from several hundred people to send a letter, Whatever happened to that?)Originally Posted by richardjames73

Here's something interesting... It's quite possible that Olympus were lying to us, not Apple...

Then again maybe they wont stop production straight away but it's possible.0 -
All the more reason to think that the £98.00 was ok as the model was about to be superceded and there were old stocks to get rid of.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Also this offer was made available to both U.K. and Irish students.
Actually don't know if everyone is aware of this but the price reduction was more than just UK and Ireland, I think it was Europe-wide on the Apple education store.
After I ordered (on the Irish site) I decided to check whether it was on any other euro sites and found the E1 with similar reductions on both the German and French sites. I'm pretty sure if i'd checked the spanish, dutch etc. it would have been there too0 -

That is very interesting indeed. Are there many irish customers pursuing legal action as well?0 -
I honestly don't know, I don't think many people will take it too far, ther is a lot of consumer apathy here and the office of the director of consumer affairs in Ireland are useless. I'm gonna follow up on it for a while mostly because the lying is !!!!!! me off.
I've contacted apple (by phone) a few times and, would you believe it, was first told that it was a mis price and that they wouldn't be selling the camera, I said ok and would have left it at that - an honest answer - except the guy followed up by saying that they couldn't honour the misprice because it would be "illegal" to sell it below cost.
That crap line !!!!!! me off a bit but i was in a rush so i finished the call after complaining that the money was still down as reserved on my cc. The next day my order was cancelled so I rang back to find out what was happening and was given the "out of stock line", so I called the guy on that and asked him why I was being lied to and explained the conversation I had the previous day. He pleaded ignorance on this but offered me a "goodwill gesture" and a crap discount off the purchase of an ibook i was enquiring about.
I told them i'd get back to them but want to have a bit of leverage before I get onto them again, so am keeping an eye on the media and have contacted the register etc. as i know from experience fighting companies by yourself can be fruitless0
