And your point is what exactly???
That Asda give out tickets??
Ok thanks for that.Hi, we’ve had to remove your signature. If you’re not sure why then you're as thick and stupid as the moderators on here - MSE ForumTeam0 -
The point is probably in a thread about "Parking Ticket Appeals successes and failures" you'll get posts about tickets people have appealed successfully. Little point in filling the thread with posts saying "why bother posting, you should just ignore them" after seeing the appeal worked.0

The danger is that people think that they should appeal when all the evidence points to NOT appealing against PPC tickets.
Appealing RARELY works [indeed it mostly makes matters worse].
Ignoring them ALWAYS works.
The above only applies to PPC and not council or police tickets.Hi, we’ve had to remove your signature. If you’re not sure why then you're as thick and stupid as the moderators on here - MSE ForumTeam0 -
Appealed against a council ticket in a restricted parking zone in Sharrow. The permits you display there are hung from the rear view mirror. Which I'd removed when nipping down to Waitrose (coz Im posh and shop in such places)
Like a doofus I didnt hang the permit back up when I got home. Picked up a ticket, but the warden was just down the road and explained the situation (he seemed prepared for more than the calm and respectful conversation we actually had) He made a few notes, I appealed. Notes where picked up by the council, and the fine was cancelled.
Cant imagine that ever happening with a private parking company0 -

I contested an won against Hammersmith and Fulham with their infamous Bagley Lane box junction.
Two things did come out of my research. The first being that when I compiled a list of cases who were successful over the past year, I was amazed at the number. I was ready to quote eleven which were very similar to my circumstances alone, but there were many, many more listed on the PATAS site.
The second was that most successful appeals showed PCNs really should not have been issued in the first place. The council just made the motorist go through hoops then did not turn up on the day.0 -

When reading the notice it showed photographic evidence of my car arriving and leaving with times. According to it we had overstayed by 13 minutes, when I recalled the day in question it was our first day there and had gone to check the parking prices for this season as we would be using the car park every day. While there we decided we would go and have breakfast in the town and return to the car park as the waves were good to get straight in.
When we came back into the car park we paid for just 3 hours as we knew we had to book into our holiday accommodation. When we returned to our car though we were blocked in by a mobile home vehicle. The passenger was in it and told us the driver wouldn't be long so proceeded to get changed out of wetsuits. After changing we still waited 10 minutes or so for the driver to come back.
I was furious then when this notice came, I phoned the local shop that is based on the beach to ask if there were any other cameras in the car park that would be able to clarify that I was blocked in. They said there weren't but even they were constantly having this problem with the parking company even over 1 or 2 minutes.
I wrote to the company and explained what had happened, and that if there were further cameras in the car park they would show what had happened, and also if they'd like to check their records they would see that every other day we were there we paid for full day parking and in no way was I trying to get away without parking. I was really pleased to receive an email off them within a couple of days to say all charges were dropped and no further action would be taken.
It was the first time anything like this has happened and I can imagine how intimidating it could be to receive one of these. I'm just glad I had the sense to check out where I stood legally. And although all advice was to just ignore it, I knew I had to write to them to tell them it was a genuine reason.:TMy Brother got one for overstaying in an Asda car park. He emailed Asda not the PPC and they emailed back saying it was cancelled. He thinks it was mentioning his blue badge that did it even though the car was there for 7 hours.
The car park is at the side of a railway station and when it was built one of the conditions was they had to provide parking for rail passengers. Originally there was an area marked for rail passengers but when the car park was resurfaced it was not re marked and they just use ANPR to time people in and out.
That's the last two pages I read.0 -
Yes there is the odd few success at the moment as we know.
Very likely because the BPA want to have a prepared file of some 'reasonable handling of appeals by their members' so they can continue to hoodwink the Government into letting them be in charge of an 'independent appeals system' from the Autumn.
Classic ones to show the Government would be those from disabled people so they can paint a picture their members as being 'nice people really' who have heard of the Equality Act. I am not surprised to read about the few cases recently where an appeal has resulted in a cancellation - but it is still very very rare.
But it is all about money to a PPC and the only reason for a few successes is the longer game they have their sights set on. With an independent appeals system they can convince even more stupid or just credulous, uninformed people to fold and pay up.
Bottom line is still that everyone should IGNORE fake PCNs in the form of 'Parking Charge Notices' from ANY private firm.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I parked in the Nugent Shopping Park in Orpington and received a "Parking Charge Notice" from ParkingEye with photos showing my car entering and leaving, overstaying the "allowed" time of three hours by 36 minutes! I have used this shopping centre before, parking for more than three hours and never received a "fine". Guess the notices must have gone up since I parked there some time ago.
Unfortunately I did not read any posts before foolishly emailing them explaining why I overstayed (I had a migraine and did not feel safe to drive as I suffer from "whirly" flashes when I get these). I also scanned and emailed them a copy of a couple of shopping receipts ("...include a store receipt from the day in question, proof of purchases...").
They state that all appeals will be replied to by letter (not email!) and I obviously have no idea whether I will be successful or not. Reading related posts I should probably have ignored the notice! My predicament is that we will be away for a few weeks and I may receive their reply or indeed another "notice" whilst we are away. I like the idea of ignoring them, as I hate all kinds of scams (especially those involving parking), but is it safe to do so?
Would appreciate further comments. Thanks in advance.0 -
Is this a pay and display car park?
Technically you would owe the landowner for 36 mins of parking (if it's free then you owe them £0.00). You DON'T owe Parking Eye the £60 or whatever they are asking for in their ridiculous demands.
I wouldn't worry too much about going away. All they tend to do is send letters with baseless threats in, and they do that for a while. They'd be insane to try it on in court, especially if they do not own the car park (in light of some recent rulings), which odds on, they don't.
In summary, the driver owes the landowner (not Parking Eye) their actual losses suffered (plus a few quid costs for chasing, unless the losses are zero) and no more.Je Suis Cecil.0
