    It's a car park with a "maximum stay of 3 hours 0 minutes" (it's free!). Apparently their sign sets out "other terms and conditions of the car park by which those who park in the car park agree to be bound". As I've never had to pay in the past I didn't notice the sign on entering (didn't particularly look for one either).
    It's a medium-sized shopping centre with shops like M&S, Debenhams, Next, Mothercare, Clarks, VisionExpress etc etc...

    I was about to pay up as we are going away but will take my chances I think...
  • BTW, they were asking for £80 or £50 if paid by a certain date (within 13 days of issue date) plus a processing fee of £2.95 for debit/credit cards. If payment not received within the "notice" period, they are asking for £80 + £30 admin!!

    So, their actual financial losses are £50 on days 1 - 13, and then mysteriously change to £80 on day 14.

    Good luck with that one in court lads (@ Parking Eye).

    Oh, and do you own that car park lads?? Good luck with that one too.

    All the car park owner (CPO) can claim from a driver in damages for any breach of contract is what they’ve lost as a result. If it's in a free car park or the driver paid, this is £0.00. Demanding more has been judged to be unreasonable and therefore an unfair contract penalty under the terms of The Unfair Contract Terms Act 1997, which is not legally enforceable. See Dunlop Pneumatic Tyre Co. Ltd. vs. New Garage & Motor Co. Ltd., House of Lords, 1914 and countless cases since.

    Eventually, the PPCs claimed losses reduce to £0.00 as well. :)

    I was a bit worried about my email appeal to them as to whether that could be considered as my "admission of guilt".
    But I see your point about the charges, it does seem odd to say the least!

    PPCs seem to work on "guilty until proven ... gullible". :)

    Makes no difference, you cannot admit liability to something that's a scam and would never stand up in Court.

    There is no court, no CCJ, no effect on your credit rating, NOTHING except letters (and sometimes the odd phone call that can be stopped easily).

    Relax, it's just a fake PCN, ignore it (as long as it's not a company, hire or leased car).

    The registered keeper will get some letters, that's all, so make sure your household knows there is NOTHING in it in spite of the debt collector and 'solicitor' letter headings and threats of court over the coming months. It's all hot air and an impersonation of authority, much like a phishing email scam it relies on victims who are too uninformed or stupid to realise what it is.

    Spread the word like we do. Only take seriously a real ticket from the Police, TFL, Council or (rarely) a real penalty from a Train Operator.

  • Just for info, received an email today confirming that the "Charge" has been cancelled and "there is no outstandingpayment due on this account".
    I am just so grateful for this forum and the info obtained, otherwise I would have probably paid up!
    Keep it going. The more people are aware, the better.

    We recently parked in a Lidl carpark and apparently overstayed my carparking by 15min.

    Town & Country sent a PCN for £90. Exact same as what is the library of EG letters.

    I fire off a letter to T & C informing them I was not driver at the time and will not be telling them my wife was actually the driver and that pursuit of this PCN I will deem as harassment and be informing the relevant persons.

    Yesterday I receive a letter from T & C telling me they have cancelled the PCN and thanking me for allowing persons to park at Lidl.

    Wow !!! That was a bit easy process, I was all geared up for more than a fight than that.

    Has anybody received this letter ?
