Ok had 3 letters today. Letter from the debt team saying if I do not pay £185 solicitors will be instructed and it will submitted to the court on 14/03/12. If it goes to court my costs will be £345 + interest and any other fees eg bailifs etc if I do not pay, They also sent through a draft 2 page Court claim form for Northhampton CC with everything completed apart from the Claim number and issue date and seal. The claim interestignly states "damages arising from a breach of contract." The second court letter details the "contract" to park at the carpark. Interestingly it says the cameras at the car park have automatic number plate recognition built in.

I would post the scans of the letters but it wont let me as a new user

still not going to answer but getting worried now to be honest has anyoen actually seen this through ?

    It's their common tactic.

I have. Over 80 times. This is their standard bullsh*t. Once you have had the fake Court claim and not caved in, they will drop it pretty soon as they realise you are too tough for them.

The issue of what purport to be official Court documents is an offence under both the Administration of Justice Act 1970 and the County Courts Act 1984.

I think we need to complain to Trading Standards over this illegal development.

It also creates an easy case for people to sue for harassment.

Of course they have - how else do you think the pictures of your letters are in the top thread if someone hasn't seen this through and posted pics of them? You should just be playing 'PPC snap' with the letters by now.

'PPC letters, threats & court papers' is the info sticky thread at the top of the forum index you see when you come off this ancient 22 page archive thread from 2008(!!) and look at the current index of threads. See my signature, the current forum is only a click away - you will soon learn how to find your way around a forum if you realise the top 'breadcrumb link' is the way back to the much more current index this old thread sits on.

And look at all these more recent posts on the subject of 'your' letter (ignore this thread which is the second result). If you've only found this old thread then you have missed all this (wait for it to load and then read the more recent info):

IMHO this old thread from 2008 should be closed - can't believe it still gets bumped rather than just read. It's fine for newbies to stumble across initially, when Googling but it really doesn't need continual bumping with replies when it's years old and far too long to be useful. The current board index is where everyone should read and post on any forum and all the newbies here seems to be missing it!

Well I thought I'd heard the last of them but today I got the big heave ho from them, seriously if I ever bump into them I am going to open a giant can of whoop !!!!!

This time a letter stating that I have a payment now due ot £185. They have now instructed their solicitor to draft particulars of a claim with no details as to their solicitors. Very threatening letter it must be said, if it goes to court they will be looking for nearly £400.

The strange bizarre thing is in the last paragraph of the letter they offer again to accept just £35!

Seriously there has to be a way of getting !!!!!holes like this shut down!

There is. Just ignore them. Once they get to this stage they are playing the last card in their hand. Shame it's a two as no-one believes a word they say, lying hounds.

If they go to court claiming £400 they will get £400 less than that amount. Unlawful penalty the judge will say, claim void. They know that, which is why they are offering to settle for £35, but that's still £35 more than you will pay if you hang on a bit longer.

So it's plainly obvious that this is penalty, what is the loss here to them £35 or £185 or even £400 ? Trying to claim upwards of £365 to take it to the small claims is clearly an attempt at intimidation and this letter should be safely filed away. But if you hold out a little longer the charge will be £0.00 as the scammers never do court.

They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

I'm on my 5th letter now from the Civil inforcement. This one is headed 'NOTICE OF COURT ACTION' and the total outstanding is £180!
I have been ignoring the letters and putting them away safely, but now im beggining to worry if my letters are the same as everyone elses. Are other peoples printed on 'Newlyn' paper? someone please help :) x

"Newlyn" paper isn't as good as Andrex. But it is of no more significance. This is all part of the "let's see if we can frighten him into giving us money we are not entitled to" campaign. Put these letters in the same drawer as the others, the end is in sight, and soon your "debt" will shrink to £0.00 as they realise they are not dealing with a MUG.

If it looks like the one here:

Ignore it. It reads like they have already won in court and that is just rubbish. It's as accurate as me saying that Scotland are good enough to win Euro 2012 when we won't even be there.

That's a bit negative, Al. Scotland still have a better chance than England. But admitted there is more chance of the Faroe Islands winning it than these losers taking anyone to court. I just wish they would, it would make my day sticking a broom handle up their a*se and wiping the floor with them. Worry ye not, bc20!
