recieved my 3rd letter from newlyn today, think thats 5 in total inc. civil enforcement ltd. It says NOTICE PRIOR TO COUNTY COURT PROCEEDINGS. then goes on to say that the case can now be registered in the county court, this will allow baliffs to remove household effects and cars from my property, and my credit rating may be affected. oh and that i have 14 days to pay.
just wondered if anyones actually heard of baliffs turning up, i wouldnt give them a thing if they did but im curious as to if its just another threat to scare people into paying?0 -
They can't just send bailiffs around, first they must take you to court, win the case, and you refuse to pay what they are awarded. You got more chance of winning the lottery jackpot than all that happening. The thing to do is continue to ignore.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
IF they actually take you to court.
IF they actually win the case.
IF you then don't pay them.
IF all of that happens the baliffs still can't just turn up.

Just to update you from my original Coppins Bridge IOW "Invoice" from CEL.
I have continued to ignore CEL letters and Newlyn, save to write to them to dispute any claim made by CEL.
Publicity a few months ago, meant that they ceased to send notices to cars parked after 6pm.
Article on today's IW County Press site, ( Sorry, I can't attach ) says that a local councillor is getting involved because notices are being received again in the evenings. These are from a new company called Creative Parking Solutions.
The land is owned by AXA, and managed by agents Nelson Bakewell. The councillor says he has written to AXA about the bad publicity for them. The agents are quoted saying that although the evening parking was relaxed for a while, the signs weren't changed so the notices started being issued again.
Seems like the company may have changed but Scam the same !0 -

Who's going to be first to leave a comment and email the reporter to explain that he should be telling his readers that they can ignore private parking tickets because private companies cannot issue penalties/fines (and that calling it a Parking Charge Notice doesn't suddenly make a charge of that amount non-punitive).
He can also tell his readers that, unless the company can prove who the driver was, there can be no alleged contract at all because, unlike Council fines, the owner or keeper is not the person responsible.
I am at work but will look again this evening and leave a comment then.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The company hasn't really changed bearpeje, Civil Enforcememt Ltd & Creative Parking Solutions are in essence one & the same, both operated by Gary Wayne.

Bah! I also got one from Civil enforcement Ltd for Irvine Rivergate (Scotland) for being there for 2 hours longer than the 3 hr max on 17th June.
- I appealed on the basis that I was with my sister who is a blue badge holder.
- They came back and said - no - this is a private parking place - these rules don't apply here.
- I wrote back and said - well the signs clearly say that blue badge get longer to stay
- They came back and said - oh we dont put the sign up sorry but the signs say you need to register your details with the management suite and there is no record of this so you still have to pay. But since we're so nice it'll still be at the less amount of £40 for the next 7 days.
Given i have replied to them - stupid I know but I thought rather than getting lots of letter I'd just reply and say here's the blue badge now !!!! off - what do I do now?

No. The only thing they can claim for is any material loss suffered by the landowner. As this was a free car-park then no actual loss has been suffered to they cannot claim anything. It will never get to court.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
