    Thanks.

I started the loan in Oct and as stupid as it sounds didnt realise it was on a variable rate, my monthly payments started out at £490.29 I know pay Jan 08 £615.26.
The other thing they said on the reply letter was they would give me £2721. back but would take it off the loan, can they do that??
Sounds to me that they have offered a pro rata refund and they take this off the loan and cancel the insurance and this is not the same as misselling.

As regards "can they take it off the loan" then others on here will say different and its up to you what you believe to be true but I would say like I have posted in the which report on PPI misselling that they can not take what you have psysically paid out of your own pocket off the PPI and interest on the ppi (this is money you have been deprived of) but the rest they can when they redo the loan. This would mean a repayment to you of what its actually cost you and then the loan redone to calculate what is still owing on the PPI and interest and taking this amount from it.

Like I say that is my understanding of it.

    Hello

I would of got your SAR from them first. Have you posted you complaint yet?

The thing is you will have to wait 40days for your SAR

No haven't posted complaint yet - was waiting ot hear what you all thought about requesting a SAR now after complaining to A & L. Cannot just request a SAR while my initial case is being looked at by A & L and soon Ombudsman or does this look badly on my side?
