PPI Reclaiming discussion Part III

    My parents were country folks too maxdp. My dad was only 46 when he was actually diagnosed and went onto the 5 year ok but was actually riddled with it...both his sisters have it now and they are alive but were younger than him but one has been through so many ops ...bag on etc. It just a gene thing and I hope and pray I aint got it or that this gene isn't there. At the moment had a letter in December saying they are doing a photo something or other test on parts of tumours etc... this would then confirm or not certain genes and hopefully our kids will not have to endure what we do now. Its all very new and we had councelling before.
    Anyway enough of my illness's... I will begin to feel sorry for myself soon lol....

    Back to PPI cause it gives you some fight. We all have our troubles and some more than others but the ones I feel for are the kids in those foreign countries with nothing and often born to die...
  • Hi everyone

    Just got a couple of questions on PPI. We are reclaiming (or trying to) at the moment. The bank have split our contract in two making the PPI and loan separate entities. Is this right? I thought that this would make the whole contract voidable, not just the PPI. The other point is that on examination the APR on the contract does not tie in with the APR on the figures we have been sent. The bank have offered compensation, but are saying they are unable to get all the figures because of the Halifax/BOS merger. Would appreciate any advice, as the figure they have quoted will have to pay off the outstanding loan, which is more than the quoted figure for the PPI. We were told the loan was front loaded and the insurance was paid off first but we are only getting a portion of what we have paid. The ppi was 75% of the original sum borrowed!!!!! Thanks

    Was this two seperate entities when you took this out ?

    Have you got any paperwork for the loan and PPI yourself?

    As regards the PPI being 75% of the original sum borrowed something seems wrong here...:confused: .

    If you can give us some other info we can perhaps help more. I am confused :confused::confused::confused: .
  • Aplogoes for hijacking discussion, I've been dying to tell you about this but had to wait for daughter to get off msn and youtube :mad: :D

    You may remember that we had sent ppi letters to creditors and have had a few of the standard replies back (wait 28 days for reply etc) anyway Monument insisted in their first letter that Payment Break Plan was activated during a telephone conversation in January 2004 when the account was opened.

    I decided to reply asking for full details of this telephone conversation as OH couldn't recall this happening, I added that activating a new card sometimes required using an automated service so sent a SAR request for evidence of this as he didn't believe this is what happened.

    Today OH received a letter from Monument saying the following;

    Confirmation of your enrolment in our optional payment break plan would have been detailed in your welcome letter for your card. Although we are unable to provide you with an exact copy of your welcome letter I can confirm that your welcome letter would have contained a paragraph thanking you for your enrolment within the payment break plan and full details of the terms and conditions were included.

    We have tried to access the recording of the initial conversation with you when your application was processed. Unfortunately due to a technical error we have not been able to access the archived data containing this particular telephone call.

    Whislt we conclude that we have acted responsibly in the management of your account we accept no liability, in oreder to resolve this dispute we are prepared to review our previous offer.

    Our position on this matter remains unchanged however we have given careful consideration to your request. I can confirm in this instance and on this occassion only, we are prepared to offer you a refund of £378.66 in payment break plan charges that have been applied to your account.

    If you would like to accept this offer we would request confirmation in writing confirming that you accept this offer in full and final settlement of your complaint. Upon receipt we will arrange for the approapriate credits to be applied to your account.

    Furthermore in respect of your request for a Subject Acess Data Request, I can confirm this will be sent under seperate cover.

    Monument have offered OH £378.66 for the payment break plan however I have kept all statements from December 2005 and I have calculated the charges as £578 something.

    The account was opened January 2004 so I am missing statements for the dates in between January 04 and November 05, these would have had payment break plan charges on too.

    So do I reply saying that the offer isn't enough as we believe (know ) OH paid more?

    Do we wait for the SAR to come back and start a new complaint knowing they have no evidence of payment break plan request on account

    Or do we accept the offer as Monument don't seem to have too many successes on the net with refunds on their ppi? Can they withdraw refund offers?

    Where we uphold the consumer’s complaint (wholly or partly), we consider whether it is appropriate to award compensation for distress or inconvenience caused by the business – even if the consumer did not specifically ask us to do so. Of course, that does not mean that we will make an award in every case. Exceptionally, we may also award compensation for distress and inconvenience caused by the business in handling the complaint particularly poorly, even if we do not uphold the underlying complaint itself.

    Is it going to be a genetic blue print for you so that you know. It would be nice for your kids to not have to worry. We always want to take the hurt away from our kids. Do you think.:confused:

  • The two were added together on the original contract and interest applied on the cumulated total, and yes, the loan was 19000 the PPI was 14278!!! A massive 75%. Loan sharks have nothing on this bank! We have had scribbled figures for the PPI but the bank are saying the loan amount is good, although we have argued that it is impossible to split the two. We received an explanation of the loan but the APR figure of 7.6% on the original document has become 7.675% on their explanation. This is surely against the CCA 1974 and we were strong armed into the PPI as we were told that we would not get the loan unless we took the PPI.

    Do not accept what they say toffee penney/ If they are offering I would send back and say it is not enough you need interest on top of that. They are on a wing and a prayer. They always hope that we will accept what they say cause they are the big guys. Hold out fot full amount and do not be disheartened. Also be careful you do not put on this site any details where you may be traced. Big brother is watching:rolleyes:
