Where we uphold the consumer’s complaint (wholly or partly), we consider whether it is appropriate to award compensation for distress or inconvenience caused by the business – even if the consumer did not specifically ask us to do so. Of course, that does not mean that we will make an award in every case. Exceptionally, we may also award compensation for distress and inconvenience caused by the business in handling the complaint particularly poorly, even if we do not uphold the underlying complaint itself.

Right now for the questions to you lovely people :D

Monument have offered OH £378.66 for the payment break plan however I have kept all statements from December 2005 and I have calculated the charges as £578 something.

The account was opened January 2004 so I am missing statements for the dates in between January 04 and November 05, these would have had payment break plan charges on too.

So do I reply saying that the offer isn't enough as we believe (know ) OH paid more?

Do we wait for the SAR to come back and start a new complaint knowing they have no evidence of payment break plan request on account

Or do we accept the offer as Monument don't seem to have too many successes on the net with refunds on their ppi? Can they withdraw refund offers?
Yeah toffee penny, like maxdp says do not accept this as full and final. I would ask for the full amount. They have offered something and would not do that for nothing...;) . Its is up to you toffee penny but me personally would go for the full amount.

The two were added together on the original contract and interest applied on the cumulated total, and yes, the loan was 19000 the PPI was 14278!!! A massive 75%. Loan sharks have nothing on this bank! We have had scribbled figures for the PPI but the bank are saying the loan amount is good, although we have argued that it is impossible to split the two. We received an explanation of the loan but the APR figure of 7.6% on the original document has become 7.675% on their explanation. This is surely against the CCA 1974 and we were strong armed into the PPI as we were told that we would not get the loan unless we took the PPI.

This certainly sounds extortinate to me. I have never heard of a PPI of such an amount... .

I would get on with the complaint and let the FOS deal with this after... you have a very strong case if the ppi was that amount for that alone. Have you contacted the FSA at all to tell them of this amount. I would and also the OFT.

They are hiding something here and you need to know more from them. Perhaps half an hour at the citizens advice or with a good solicitor would be an option too.
