    Yes. I use that word every time I write to them! I have copied the OFT Guidance to them and taken a highlighter pen through the relevant section as they have clearly been chosing to ignore the legislation. That's what I find really frightening - they know that they are in the wrong but just keep saying, "We're not going to put this on hold or stop interest accruing" and even responded one time saying, "We're not giving you back your bank charges" even though the letter was nothing to do with bank charges :rolleyes: It's clear that they have no willingness to listen to customers or obey the law or good practice and for that they should be punished.

    It was for this reason that I got a letter from the OFT in which the OFT said that they felt this unlawful behaviour and contrary to their Guidance Note. I copied this to the Chief Exec at Sainsburys who then passed it on to one of his minions who responded with, "We're not giving you back your charges!" :mad:

    Is there anything on this site about multiple agreements as in the PPI should be listed on the agreement separate to the loan just this post is so big and unlike on cag posters do not have there own posts so am finding it a bit difficult to find.

  • This is my first post and I would be very grateful if any kind members could run their eye over my first letter to the Halifax. I am actually one of the rare people who wanted Payments Protection Insurance because it was for my joint Mortgage!! Does anyone think my letter is a bit long-winded or should I just list the ‘highlights’ and leave the details for the Financial Ombudsman if I am not successful with the Halifax?

    Incidentally have no idea why I am a customer of the Halifax because I find they are the most unhelpful firm I have ever encountered but I guess I thought it would be too much hassle to change companies!!

    To say that I was gutted when I first rang the Halifax about a possible claim a couple of weeks ago and to find that what I thought was a joint policy only covered myself is an understatement!! Apart from anything else my husband earned over three times my wage so it wouldn’t even make sense!! Sorry for rambling so here goes with the letter!

    Anyone think I have a claim? Thanks in advance for any advice given.

    Letter to Halifax:-

    Dear Sir or Madam
    Account Number:
    I purchased the above policy from you in May/June 1999 but now believe that I was mis-sold this policy for the following reason:

    having recently contacted Halifax Insurance I was informed that only myself, ************* is fully covered by the policy and my husband, **********, is not covered at all, when I was led to believe that all parties were equally entitled to the insurance cover. With regard to same, I would ask you to note the following:-

    6.5.1999 at 7.30 p.m.

    Myself and my husband met with *********** of ************* (Halifax Agents) and arranged a joint endowment Mortgage with Mortgage Protection Insurance. We signed whatever paperwork was given to us by your Agent at this meeting fully confident that we were being taken care of by your Representative. You will note that we have since changed the Endowment Mortgage to a Repayment Mortgage. We were quoted £10.50 per month (which has increased yearly) at that time for the monthly Mortgage Protection Premium and were given a brochure re same. We resided at ********************* at the time of our application.
    12.12.20008 at 5.35 pm

    Rang Halifax Insurance (0845 6001194) and spoke to Alice. Told her that my husband may be laid off work from the 19th December 2008 and wondered what the procedure would be if we needed to make a claim. She checked my details and stated that the Policy was in my name only!! Told me not to worry that it was probably just a paper error. She told me that the application was only made in my name only (even though as previously stated we signed whatever paperwork was given to us by your Agent at our meeting on the 5.6.1999). Told me to go back to my Agents and if they could confirm that the application was made in joint names then the Halifax would honour the Policy. I explained that my Agents had ceased trading a number of years ago as *********** (the Principal of the firm) had retired. She told me that all documents from that Agent would probably be transferred over to the new agency in *********. I confirmed to her that I had only ever received three letters specifically in relation to the Mortgage Repayments Insurance and all were addressed to both myself and my husband and not to myself alone. I note that one of the said letters refers to a Certificate of Insurance and Conditions Booklet. Please note that I only received the Conditions Booklet. I enclose copies of said correspondence for your ease of reference.

    13.12.2008 at 11.30 a.m.

    Spoke to Denise in Halifax Branch ************ She confirmed that they hadn’t received any paperwork from *************** when they opened their Halifax Agency. She was very helpful and suggested that she ring the Halifax Insurance on my behalf. However, on doing so the Halifax insisted that the Policy was in my name only. Denise said that the Halifax stated that they had, in fact, sent me correspondence re the Insurance (referred to a letter sent in 2005) but I can categorically state that I never received any correspondence other than that enclosed. I keep precise records of everything (including dates, times and names especially when I speak to the Halifax if I have any type of query).

    Decided to ring *********** personally at his home after making enquiries as to his whereabouts. Apologised for ringing him but felt I had no choice. He confirmed that he didn’t have any paperwork from the Agency and hadn’t had any for quite some time. Advised me to ring the Halifax and demand a copy of the actual documents they received which they were relying on. Stated that they would definitely have a copy but would fight to give it to me. Agreed that the Mortgage Protection Insurance would have been made in joint names as it was a joint mortgage.

    Rang Halifax Insurance and spoke to Nicola. She was initially unhelpful saying that they were very busy. I asked for a copy of my application but she said they wouldn’t have it. I insisted on getting a copy - if they are relying on an application for my name alone then I had a right to see it. She told me that some of their computer records hadn’t been transferred over or been updated and she would put a request in which would take approximately 3 days. Said that hopefully it would transfer and show that ******* was on the policy!! Said she would ring me back.

    Rang Halifax Insurance and spoke to Catherine. Told her that Nicola was to ring me back but hadn’t. She said that she could see that Nicola had requested my records and had received an email to say it would take some time. She said that she was going to email Nicola a reminder. She said that the delay was probably due to the Christmas holidays. I told her that I intended making a claim for being mis-sold my insurance. She confirmed that she could start the process there and then. I told her that I wanted to write directly to Halifax myself. Told me to do that if I wished but she would email them to let them know my intentions. She gave me the above address to write to.

    Myself and my husband have paid our Mortgage Repayments Insurance, with regard to our new house, faithfully since 1999. It is absolutely ludicrous to suggest that this Insurance was taken out in my name only. We made our application in good faith fully confident that our instructions were being carried out by the Halifax Agent. As a longstanding customer of the Halifax, since approximately 1987, I would also like to point out how disappointed I am to have not even received a courtesy phonecall from Nicola (see entry re 15.12.2008). I am appalled to find myself in this situation through no fault of my own.

    Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

    I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

    My hfc loan is in joint names and im quite sure that im the only 1 covered on the ppi,
    Will this make it easier to reclaim?
