    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Hi all,

    I am in the process of claiming back the PPI that was mis-sold to me by Egg. I initially called up to request a copy of my agreement as I felt I had been mis-sold the PPI and the girl on the phone instantly told me that they could refund me £800! which would come off the balance remaining on the loan. I said I wanted to see a copy of the agreement first before I took this further (which has taken a month to reach me!)

    Anyway upon receiving the agreement I have paid a total of £1671.48 in PPI alone!!! What I really wanted to know is does the refund have to come off the balance of the loan or can I request the amount in a cheque?!

    Hope this makes sense, any advice would be much appreciated.

    I dont know when we first got the card and I only have the last 3 years statements, I checked on Virgin money and the payment protection cover is
    Underwritten by St Andrew’s Insurance plc and arranged through MBNA Europe Bank Ltd I have look at the policy on line https://wwwa.applyonlinenow.com/uk/summary0407_ost/mbna0407.htm
    it looks like we could claim if he closes the buisness but not if he is off work sick as he has no contract of employment, but i amy be reading thing wrong

  • First post, but have been a long time user of this website.

    I followed the really helpful advice on the Reclaiming the PPI article and as a result I have recieved an "offer" from Alliance and Leicester for £499.41 (including intrest at 8%) which I beleive is well below the amount that would be due in full, the full PPI contributions are £1056.

    This offer was recieved without any dispute to my orginal claim from A+L.

    What would be the best way to proceed? I'm in no rush to get this money (altough obviously it would be nice), so no need to take the cash and run yet unless its best for me.

  • Wow! Got a letter from the FOS today telling me that my case will be passed to an Adjudicator by the 4th March and that they will be in touch to explain what will happen next. (I'm astonished to get something that was more than one line from them!)

    Fingers crossed! I will also be sending them a copy of the letter I'll be getting from my GP in relation to my Egg PPI complaint which proves my pre-existing medical condition. Hopefully they'll add that to the pile of evidence against Sainsburys.

    In the meantime, Sainsburys continue to add interest to my account with them (it presently stands at about £1,350) as thye refuse to put this on hold pending the outcome of the FOS decision.
    Almost debt-free, but certainly even with the Banks!

    Check this out 1st.

    If you send them a letter saying the account is in dispute,
    then they cant charge interest whilst this is going on.

    Oh and make sure you put on the letter at the begining and end without prejudice.

    Well done! :j Can I ask whether your agreement was a credit card taken out between Jan 05 and Dec 07? (These were the dates between which the FSA deemed EGG to be putting pressure on customers to close PPI sales and ordered them to offer settlements to people). I'm arguing with them over PPI from before that date and it's proving a bit more difficult!

    In terms of receiving your settlement, they normally apply them to the outstanding balance of your card (if they did this with me, it would leave me with only bout £200 outstanding and I'd dace myself a little jig of joy :j!!!!)

    I've quoted them the legislation and the OFT Guidance Note but on the 17th :eek: , yes 17th! instance I have written to them quoting this, they have opted to ignore this! I've asked the FOS in adjudicating to consider me for a compensatory payment as a result of this unfair and unlawful treatment by Sainsburys as a result of their bullying (in addition to my claim for the miss-sale of PPI).
