    Hi there,
    I took out a hfc loan over the phone in dec 2006,
    I have received 2 yearly statements that i have just opened(as i pay on time so didnt feel the need to read them)and have realised that i pay £46 per month in ppi on a £9000 loan.

    I cant remember if i agreed or not to ppi,and its reading the posts on here thats got my brain ticking!!!!!
    Can anyone advise me of the 1st thing to do to check this out.

  • So it looks like I'm in for a long wait as I'm now having to go to the FOS.
    HFC's 8 weeks was up on christmas day. I rang on the 24th to be told that they're that busy looking into complaints that mine hadn't even been looked at yet but that they would email their team leader to put a rush on it. Phoned again today and it's still sat in a pile. But asked me not to go to the FOS as they did want to sort this out internally and that they would email the team leader again. Would another letter giving them 14 days to sort help do you think and would it be wise to get an SAR before taking to the FOS??

    Hello there.
    Seems they did not give you an option of the PPI then hun when they sold you the loan, so they automatically added this then.......:rolleyes: .

    You will find some useful PPI info on mis selling and if also any of them occur to you then get a letter in to complain and reclaim.

    There is a letter template on that link and they have 8 weeks to respond in full, another letter maybe required if not successful or until you receive a final response, where they usually confirm to take it to the financial ombudsman to investigate if your not happy with the outcome of their final response.

    Keep us informed of this in order for us to help you to the following step if required.
    Post by recorded delivery, this is for your proof of posting and to keep an eye on the 8 weeks they have, because even if they do not respond by the full 8 weeks, you are then also eligible to take the complaint to the financial Ombudsman service (FOS).

    Do you know HFC were fined for mis selling PPI, this gives you a good chance of being successful here, so fingers crossed and the best of luck.;)

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.






    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Personally I would now move on to the FOS, fill out a complaint form, also keep a copy for yourself and send HFC a copy, tell the HFC that you feel its time to complain to the financial ombudsman service as they have reached their time-limit or more to deal with the complaint.
    Tell them there is a copy of the complaint form enclosed.;)

    I hear sometimes this can help, where they may even write back with a favourable response for you, knowing that you have sent a complaint to the FOS.

    You can downloand a FOS complaint form here:

    Or ring them for a hardcopy through the post.

    Always enclose copies of all correspondence with the complaint form to the FOS.

    Some still continue to complain while waiting for SAR docs, but if its further evidence you think you need to back this up then you can wait for those to come through first from the SAR if you want to.

    I'm doing ok thinking of returning to work but not sure how are you.

    Was reading the post regarding taking down the decos. I am the same take mine down on new years day, I love it looking spacious again and clutter free. Only my tree to go.

    Thanks Di, I'll definatley make sure I get this done 1st thing next week. Hopefully it'll move them along so I dont have to wait months for the FOS to deal with.

    Yes, with a bit of luck it will push them on a bit. Good luck.:D ;)

    I know its a gamble with the FOS, some are lucky to have their complaints done with in weeks, some can take as you know many months, again depending on how complex the case it, hopefully yours will be more straight forward.;)
