    Firstly this is my first post and there is a ton of information that my poor brain is still trying to digest.

    I took out a loan with Northern Rock back in 2005 and being the lazy sod I am never really paid too much attention to how much I was paying on PPI, as well as what it actually covered.

    I'm not sure if I was actually missold the PPI as the sales person was very fast at going through it but he may of mentioned all he needed too (though this was back in 2005), would it seem reasonable to be able to cancel it and should I expect a refund of the previous payments?

    If you are unsure then perhaps you could take a look at this link to see if any of the reasons come to mind or perhaps request a subject access request from them for a cost of £10. This is all the information that the company hold on you and may include the phone call (if it was phone!!) of the time you took the loan out.

    Hey nice to see you here too, yes i have complained to the oft and fsa but i will phone the fos tommoz and get an update and let them know of the treatment im getting.

    Di was telling me about your new fireplace. I think all jobs seem small until you start them lol I'm sure it will be lovely when its done.

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.






    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Yeah tell them you are losing any monies that you would be getting back and feel backed into a corner and that they are not treating you fairly. Just keep on at them and also I would say about your previous stroke too as this stress cannot be helping things now. You may have to send them a copy of your medical things but it might be worth it and get you there sooner.

    Yes, little jobs can turn into big jobs and mostly do for us. This house has been a nightmare but its a job really that happened for a reason and needed doing.;)

    It will make a difference I'm sure when its finished, nothing better than relaxing in front of a cosy fire.

    I'm fine thinking of going back to work soon not sure though.

    If it was a single premium and you cancel this now then you would probably have to have a new loan and they would only rebate a small amount back to you. This is often very small and your repayments will only reduce by a little too. If you did not know all this then this can be classed as misselling too as you were not offered to get a cheaper policy but you have to complain to the person that sold the insurance to you if you used a broker...???

    If you feel after all this you were perhaps misled and you can make a complaint about it
    Just take a look at the link here and see what you can add and delete from the template letter. Its always best to do your own from this. There are lots of reason on there for the misselling so pick out the ones that are applicable to yours.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.
