    25% paid out is better than getting nothing back at all or as you do not want to go the court route yourself then its your only other option. I really hope you sting them dreamer. They missold it to you but know you have no recourse with the FOS so are using it against you and that is maddening thing. They shouldn't be allowed...:mad:

    I know they didn't even answer any of my questions in my two letters to them. They know they can't answer them dip S**ts what they are. Hate them soooooooooooo much for what they have done to us.

    I called them too to tell them want my letters answered but not waiting for them for ever so have took the next step.

    I had an existing med condition too before the loan was taken out. Was off for 6wks with low mood. Think this will count anyway. Also had life cover on mortgage and that all I was covered for. Totally pointless PPI

    Hopefully a tale of hope!
    We took out a loan with "They whose name shall not be spoken" in Oct 2006 via a broker. They sold us PPI with the loan which was the usual single premium policy to a value of 15000. Owing to circumstances we renewed the loan in March 2007 but did not take out the insurance again as we would have to borrow 25000 to renew it.
    Then my wife saw Martin on GMTV, the light was switched on and we used the templates to write to Barclays First plus, got fobbed off to the broker. Broker fobbed us off with final response, gave them a second chance, broker told us their professional indemnity insurers said we were wrong. FOBBED AGAIN!
    Didn't give up though, sent complaint to FOS. This has taught me the value of patience. After 10 months out of the blue the FOS adjudicator rang me to clarify some points as I had used the scatter gun policy in my complaint. He then asked me what seemed to be a totally obscure question regarding my insurance on my first charge. Do you have your own insurance on your first mortgage and if you do, could you have topped it up? The answer was yes on both counts. This seemed to change his attitude to the validity of my complaint and he almost said that they would have to be very clever to get out of it and if I could prove it my complaint would almost certainly be upheld.Coupled with the fact that we'd had no policy document just key facts and they had not been able to supply him with one. It seems my complaint may be upheld on grounds that I had not thought of! My point is don't think you have to be a barrack room lawyer, GO FOR IT!! The FOS seem to be extremely helpful and not overbearing, if you !!!! up you will get a chance to put it right. I might have been lucky cos my adjudicator seems very human and helpful. I am watching what I say cos it will be a few weeks until I get a result one way or another so I don't want to tempt fate!!
    Hopefully I will be able to update this if anyone is interested in a few weeks with a positive result. But if you are having doubts, you have been fobbed off then don't, it's not as daunting as you think!! DO IT YOU'VE GOT NOTHING TO LOSE!!:beer:( I hope!)

    Just an quick update on my claim for 2 policies with Lombard Direct. I sent my complaint in October explaining the policies were missold (the policies were never explained to me and I did not know I had them until I looked at my paperwork). Both loan applications were processed via telephone. I had the standard letter saying please can I complete a questionnaine which I returned to them uncompleted saying they should already have this information if the policies had been sold correctly. Anyway the last letter I received from them was at end of November saying sorry but they are still looking into my complaint, and need more time (they was meant to give me a final response by the start of December) I am just wondering whether this is normal that they have not sent their final response. I mean, if they was going to say no, would they have let me know by now. I know I can complain to the FOS but I was just hoping they may have contacted me in December, which they have not. Anyway I am going to call them on Monday anyway for an update on the status of my complaint. Is a nicey nicey approach worth a go to the person dealing with my complaint or not. I'm thinking is the advisor really going to be bothered if I start saying to him on the phone I'm going to be taking this to the FOS? Don't get me wrong, I will submit my complaint if I dont receive another response within say a few more weeks and I will advise the bank I am going to be doing this in writing. Any advice appreciated. Many thanks.

    What broker was it then?? I take it your complaint is with the broker?

    No, not really as they often tick this for you...;) . Are you saying this was ticked by them and not you??
