    Thanks for the encouraging post Maxdp ;) it amuses me that creditors tend to send the same letter out in their response to a ppi claim. I am researching the net to find others in similar situations (quite sad really but this ppi thing is bugging me and knowledge is power as they say :cool: ) we have nothing to lose and a few quid to gain so we are prepared to go to the FOS, it's free to do so!

    However don't want to look a total prat so need as much proof as I can get. So I will send a SAR request to Barclaycard, some applications are very misleading as you say Max and will state 'tick here if you do not want insurance' and most will leave blank thinking 'I don't want insurance' I have seen an application form with 'don't sign up without it' near a ppi box. I think this is very misleading so I want to see OH application form.

    Now I have found others having been sent the same letter but with date changes relevant to them it makes us want to fight it even more :D

    Think this was posted on here before, can't remember who posted it, Marshallka maybe, but I just found this over at CAG:

    David Cresswell, spokesman for the Financial Ombudsman Service, said: The January 2005 date refers to the start of general insurance regulation by the Financial Services Authority – when the FSA began regulating many types of insurance for the first time, including payment protection insurance.

    It is true that if you bought your policy before 31 January 2005, then the seller may not have been regulated by the FSA. It is only companies that are regulated more widely by the FSA – banks, building societies, insurance companies – that will have been covered by the FSA before then.

    If the seller was an insurance broker or some other seller, such as a car dealership selling PPI alongside finance agreements, then the sale of PPI would not have been regulated before January 2005. But you may still complain to the FOS about PPI sold before then if the complaint is about a claim - where the policy does not pay out when you think it should do.

    In this case it is the underwriters - the insurance company deciding your claim – that you are complaining about and these companies will have been regulated.

    You may even be able to claim that a policy sold before 31 January 2005 had been mis-sold if you can show that the terms of the policy contract were unfair – again it would be the underlying insurer that you would complain against..

    Just going through that PPI document again and here is a bit about the Premium:

    PREMIUMS

    1. At the discretion of the LENDER, this policy may be paid for either as a single premium for the cover of the initial term, or by monthly premiums.
    The premium(s) payable by you for insurance under this policy are set out in your agreement.

    2. Where you are paying monthly premiums, cover shall be for monthly periods and the continuance of your cover is conditional upon your continued payment of such monthly premiums.

    3. In the event of termination of this policy by you or us, no monthly premiums are refundable.

    4. Where you have paid a single premium and have repaid all sums due under your agreement before the repayment date and within the first 5 years lof the agreement, we shall pay a "part refund" of premium to the LENDER for the credit of your account.
    As our risk is greater in the early years of the policy, the premium is not spread evenly throughout the term of the policy, but is weighed towards the earlier years.
    Refund calculations take this into account and are not calculated on a pro-rata basis.
    For example, you would receive about a quarter of the premium back if you settle half way through the term of the policy.
    Further information is available on request from the lender.

    On that bit I added on here yesterday (Endeavour/HFC/Hamilton), the part about complaints, did you notice they have 2 lots of 8 weeks procedures?:eek: I'm sticking to the 8 weeks.:rolleyes:

    Can I please ask for some advice. Im a full time student with kids on a looow income. I have negotated all of my credit cards to intrest free, low payment ect. I have decided that this is the year to loverhall my money as I finish my nursing degree in six months and hope to then be in full time work. I have just looked at my LLoydstsb credit card and Im paying £90 per month in PPI. Do I claim all of this back and has anyone else had any success with them> Iv had this card for donkeys years say 10 +.
