    You have already made the complaint and you take that date (of the first complaint) and then add 8 weeks for a full and final response so its now whatever time is left from then.

    Hi All,
    Good news Di!
    Any advice greatly recieved here! we have a claim against ge money for ppi and charges going through mcol, ge money have put in a defence which we recieved in the post, but as this is our 'test case'! we've been doing the research and we're supposed to have an allocation questionaire (would this be right) but we didnt receive one ,only the defence,do you think this means they dont really want to go to court ? or are they just slacking in their duties as per norm!!!
    Sorry l have'nt been here for a while been having rant with nationwide, they've called in half our OD as from last week and the little bit of WFTC that we get,last month they 'stole' in charges and this month wont let me take it out to pay bills as they've decided they'll keep it towards OD!
    They're sooooooo gonna get it now!!!!!:mad:

    Hope your okay hun.
    Right then hun, where were we on this?
    I take it they sent a letter of offer, obviously its not looking good on the amounts they have offered, personally I would give them 14 days, but if you want to double check maybe Marshallka will know the proper timescale for this, just in case, but 14 days should not hurt them.;)

    I would write back and tell them

    Thank you for your letter dated XX/XX/XXXX regarding an offer of £----

    I am sorry but I am not satisifed with your offer where I believe now the Financial Ombudsman Service will investigate this for me, if you are unable to reconsider the offer within 14 days of my letter I will have no option but to take this case to the Financial Ombudsman Service in order for them to investigate.

    Its up to you, I'm not that good with letters to be honest but as long as you mention everything and do not miss anything, it should be okay.

    As always post by recorded delivery.:D

    Di, if the complaint was only a couple of weeks ago then you still have to give them 8 weeks from start to finish so whatever time is left from the first complaint. If its only 14 days then fine but FOS will not look into this until 8 weeks are up or a final response. I would mention that you require a final response in the matter in order to take this complaint to the FOS to investigate on my behalf.
  • PLEASE HELP!!!!
    I put a claim for missold PPI in to HBOS way back in March 08 which was subsequently turned down. After all the relevant letters sent I finally contacted the FOS who upheld my complaint and said the deadline for the money to be payed was the 11th August. I recieved a letter from HBOS a couple of weeks later saying they would pay in full + 8% interest. Since then I have made weekly phone calls to the bank (they have never contacted me once) and yet I still have not recieved any payment (date is now 3rd December 08)
    HBOS are telling me that because I have a migrated loan (they sold my loan to another bank) it is more complicated to work out! I have contacted the FOS again and they say all they can do is keep contacting the bank in order to put pressure on them. I am becoming increasingly frustrated and skint, Please can anyone tell me if there is anything else I can do to make them get a move on?????

    Sorry to hear your issues here hunni, what are they like ?:confused: :rolleyes: .

    Right okay questionaire wise hun to be honest I do not really know how this works, if its regarding the courts etc but someone will be able to confirm this for you, maybe you could just give them a quick call and see what they say in case its mislaid.;) This one is I assume about the charges then?

    You could be right, maybe they are stalling, it also maybe worth you writing to them to keep on par with them if you know what I mean, at least your dealing with it.

    I do hope this gets sorted out, but as you know try to keep everything in writing this is your proof and the recorded post is too.

    Someone will be able to confirm this to you hun, I am wishing you luck all the way.;)

    Yes your right, I was possibly thinking - as they normally give you something like 14 days with an offer, think its that anyway, think mine was with LV.

    OMG :eek: that is so pathetic of them !!!!:mad:

    I know many send a LBA a letter before action, I did send one of these myself to a company and they paid out, one of my cases dealt with by the FOS the final decision was Oct 2007, the company finally paid out in Jan 2008, it was something like end of Dec 2007 I sent them a letter plus email for them to pay out or further action will be taken through the courts where they would have to pay out the costs.

    I gave them 14 days to pay out, they paid it out day 12 from the letter.

    They know they must pay out.

    However, if you want to do this, mention this to the person from the FOS dealing with your case first, as they may require a copy for their records as they did with mine.

    The annoying thing is right now, I am unable to find the letter (LBA), but maybe if you suggest this to the FOS first, see what they say, because to be honest that is pathetic.......:mad: , they know they must pay out and the word court now its all in your favour will probably make them think twice.

    Its up to you hun, a simple letter just to mention this would be okay.
