Here is the SAR template (Subject Access Request), you can use this for any finance companies, remember to delete what you don't require, and enclose a cheque or postal order payment of £10 and post by recorded post, they have 40 days to comply to this request.;)

I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts And or credit cards
Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans and or credit cards, payment protection insurance and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization:
-Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same.
- A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization.
-Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.
-Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.
- Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.
-Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.
I enclose a cheque in the sum of £10 to cover your fee.
IF YOU UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIATELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROTECTION.

It's now forty days since we requested a SAR from Nemo. They sent a letter giving us todays date as the day they had to reply to us by, but we have had nothing from them at all. What do you think we should do now?

Hi all
I have been lurking on these boards for some time now but this is my first post. have recently written to Capital One to reclaim the PPI I have paid on my credit card over several years. Today I have got a letter back from them saying that I was sold the PPI during a phone conversation, the script was clear and not misleading etc etc and that I would have recieved the full terms and conditions and a 30 day cooling off period.
Its basically a standard "off you go" letter. Is it worth sending the second letter? Has anyone had much success reclaiming PPI from Capital One

No. I'm certain they did not. Isn't this (and some other aspects) a case of their word against mine though?
Right then, give it your best shot and I must be honest here, its possible they may try to go against your word here but the main of us get this, so if you feel you have a case I would definately give it a try, if this goes as far as the FOS as they will take these complaints seriously they will see your point here, you should have known and I was thinking if the other side argue this case and if this loan was taken out after Jan 2005, any telephone calls made would have possibly been recorded, myself and others have requested copies of the telephone calls which I received and this also helped my case with the FOS.;)
Although you may need to request a SAR (Subject access request) to receive this, I have added the SAR template in one of the above posts if you want to check this out.

If this was not their final decision or if they have not mentioned about the Financial ombudsman yet at this stage then yes send them the 2nd letter, you should find this on the link here:

There are also downloadable complaint forms on the link or you can contact the FOS direct where they will post you one, also enclose copies of any correspondence and final letters to back you case.;)
