    As you know hun, my provision decision (Nemo) was made in August 2007, and the Final decision was not until October 2007, 2 months after, yet it had taken as again you know approx 14 months from start to finish by the time we received the payout.......:eek: .

    Hi Di

    I know you had to wait ages. Mine have paid out some but that was in July and have heard nothing ever since:eek: Have asked for proper working out but nothing. Adjudicator keeps passing messages to them but no reply whatsoever. It is very frustrating,:mad:

    Just re read that Marshallka seemed a bit harsh but you know I did not mean it like that. Just meaning sorry you are having same probs.:D

    I am not offended here maxdp... I am so impatient and must say I am so lucky to have mine looked at so quick but what I do object to is the business holding the reins and it always seems that way with my experience. I just thought FOS had more clout than they have. I know they are only mutual but surely if they ask the business to respond by certain dates it means exactly that. They give them too many chances and let them get away with far too much....:mad:

    Also an update is not hard to give if only to say "sorry not heard anything"...a junior could do that...

    I'm sorry to moan, I'm broke....:o :o

    She said would do it staightaway and so I should receive in the next few days. But who knows! No mention of the age of the loan being a problem which I was pleased about. I see somebody mentioned there have been people with successful reclaims of over 6 years is that correct?

    Nice one but it might be best to request them by letter too (recorded delivery). I phoned my bank and they took 3 months to send them out as i made the same mistake of phoning..learn't my lesson now...:D

    Yes Robbie, it has been known for some to be successful in reclaiming prior to the 6 years.;)

    Even though you have rang the department, write a letter over the weekend to cover this call if you can and say:

    "Due to our telephone conversation on Friday 21 November 2008, I look forward to receiving the copies of the Agreement and the Breakdown of calculations in the next few days as this was confirmed by yourselves that I will receive these over the next following days", as these documents were missing from the SAR I received.

    This way, this is your proof, and also like Marshallka has said is to send by recorded post, this way they know they must provide these as part of the subject access request.
    They cannot avoid doing this then, as you have covered this both ways.;)
