    i will know the date by the letter on my 'puter at home, plus the slip for recorded delivery. its certainly more than 40 days.

    what/who are the ICO??

    is there nothing can be done to get them to refund it, without the going to court?? its something my daughter just cannot afford to do.xx

    Not sure where you would stand within the Financial leasing association/authority (FISA)), maybe you could contact them and see if they can help in any way, not unless someone can confirm otherwise they not able to help, here are the details if the above:

    Not sure whether anyone would remember, given that this thread is now so long, but about a month ago I wrote to Carcraft as it appeared they had sold me two PPI policies to cover the same loan.

    I heard back from them today, informing me that in fact one policy was PPI, and the other was an NAC 5 year parts and labour warranty for the car, and the respective PPI for that finance agreement.

    I've never heard of this policy before, and certainly wouldn't have knowingly taken this out (at £56 a month!) on a year old car when a close family friend is a mechanic who has always worked on my cars for nothing!

    Meanwhile, I'm still paying PPI on the loan as well. The letter from Carcraft says, and I quote, "it is possible for you to cancel the PPI policies should you wish to do so and receive a pro rata refund", but now I'm stuck with this 5-year warranty and the payments on that that I would just ever have knowingly signed up for!

    I've requested a copy of my credit agreement from Creation Consumer Finance about this NAC cover, but it's not turned up yet. Apparently, according to Carcraft, I should have received documentation subsequent to sale from Creation, but this never happened. Also, upon Googling this NAC cover (as I have no documentation) it appears that I've unwittingly invalidated the NAC warranty anyway, as my car wasn't serviced within 6000 miles from the point of sale!

    I'm aware I'm veering slightly off the PPI topic here, but I'm about as confused as I can be so any help would be gratefully received.

    Seems like they are messing you about then.

    Yes you should have received all your documentation of everything.

    I would write back to them and request for copies of everything they have on you, tell them if they do not supply this you will have no option but to contact the Information Commissioners Office, known as the ICO here:

    Also check the above link out for some information which may be of some help for you regarding the information you require.

    So the 8 weeks have passed then I take it since sending and receiving the feedback from these.

    I would also contact the Financial ombudsman service here:
    http://www.financial-ombudsman.org.uk/contact/index.html

    Explain to the FOS about your situation and see if they are able to investigate this for you.

    As they normally say these finance firms have 8 weeks to respond, wel any company you contact have 8 weeks and if they have not resolved your case and your still not satisfied then to get a complaint form into them with enclosed copies of any correspondence to help with your case.

    If you need more info and help here then feel free to post away where one of us will try our best for you.;)

    On my Nemo complaint I would receive regular replies, yet these numbers of complaints are getting much higher.......:confused: .

    Thanks for getting back to me. It's not been the 8 weeks yet, think it's been 3-4 so far. They sent me a form to fill in to say whether I agreed with their decision or whether I wanted it reviewing and why. Obviously I have the reasons in my last post to cover that one! I'll do as you say though and request a copy of all docs they hold - will be interesting to see what I should have received!

    I've also been given a telephone number for the Customer Services Manager at Carcraft, who says that she is willing to try to help in these kind of situations, so I may give her a call tomorrow as well to see if there's anything she can do...

    Will keep you posted (I suppose still relates to PPI, as I'll be claiming that back on the NAC loan as well!) and thanks again for your help :D.

  • thank you muchly kind people. i have printed off the page that came up on the link for ICO and will deal with this when i get back home at the end of the week. they are robbing gits and are wriggling out of their responsibilities to the customer. they clearly dont know what they are doing; one of the letters she got back from them said that they were writing about her phone call to them of 16 th may. she hasnt ever phoned them!!!

    If they have this about the phone calls then hun then they should be able to provide a copy of the recordings for your daughter.;) See what they say to that. x

    Good luck Sal and yes as its PPI related then the FOS will be able to investigate this, see what comes back and if you have no joy by the time 8 weeks have passed get a form filled in, even if you have not heard, because you can tell the FOS you have given them the chance to resolve this and the deadline has passed, they will then move on with this for you.;)
    Infact you can always ask the FOS to write to them on your behalf, they will not ignore this then.;)
