the first letter 16-10-08
response letter 22-10-08 this did not acknoleged all my claims, ie; previous acc; the response was to my existing account, but the complaint was for past & present.
2nd letter 24-10-08 no response
sent 3rd 12-11-08 no response to date.
all these were sent to the complaints & quality assurance dep
documentation was asked for on 16-10-08 from where i had loan from & complaints. all letters were recorded delivery. 40 days to resolve is clearly not on there agenda.

No but have just told fp if they don't send calls in next 7 days will make a complaint to ico because they have failed to comply with my request for the calls.
Told them I requested all info in 2005/2006 and they have failed to supply.:mad:
Now they tell me will have to pass it on to someone else. She was saying could not see any calls I told her I have a paper document with calls showing names and dates so there is, kept saying just get someone to send out the calls this all I want.:mad:
When I told her about ico she said I have acknowledged your complaint advised her was not complaining about calls it was cause they sent my letter to old address :mad: :mad: :mad:

Fp even told me had to go to ff for the calls, said how can I go to ff for calls when they were held with fp. No wonder people get angry.:mad::wave:0

they certainly havent sent anything other than a couple of letters and i particularly asked for proof that my daughter had a signed agreement etc in relation to the PPI. so i suppose they have fallen down on that one.
and as i asked before, and as has been happening with credit cards thats cant produce an agreement - does no agreement mean its not enforceable??
When I pushed for a credit agreement they admitted I hadnt got one,they then closed my account and were going to default me! I wrote back and said I was still paying so how could they default me?
Sent a complaint to the FOS but not sure what part they are investigeting, no credit agreement or handling of no credit agreement.
If they have no agreement it may be unenforceable but they will default you even though they are not allowed to. But do send an SAR.
I am waiting for the FOS to finish their findings before I try court.DS1 12/10/04

I read Martin's article and thought I will give that a go. So 1 Friday afternoon I used the templates provided and sent off my letter claiming I had been missold a PPI policy on my 2 previous loans with HSBC - it was never explained that they would be taken out as a single payment.
It took them the full 8 weeks to reply and then they were claiming they needed more time to investigate matters further. I duly got a letter of rejection which basically said if I was stupid enough to sign the paperwork with the figures on then what did I expect.
I sent another letter pointing out that the sales advisor had failed to point this out to me when explaining the figures. That I had not been advised that I could cancel the policy in 14 days (although I did ask). I stood my ground and questioned their customer service records. !

phoned FOS they said blackhorse was not regulated by them till 07 so would not deal with my case because it go's back a lot further. advised i contact the FLA help, wasnt expecting that has anyone dealt with the FLA & how did they get on in comparision to the FOS.
thanks marshallka for advice, wont believe £10 cheque just dropped on mat, posted saturday,so why have i had no response to previous letters seems really fishy about this SAR, going to ring ICO, just to be on safe side.
right just phoned what a horrible witch i got felt they dont like enquiries or complaints, told her she had got a !!!!!! attitude, in the end told me a lot of company's dont charge,& if they dont comply ring back to complain. round & round same circles all the time.0
