    there driving me mad, this company have acknoledged my first letter, denying mis-selling, as to everything else they have made no contact, except for the latest phone call. the 40 days for this complaint are up next tuesday, but i havnt got any where due to there none complaince, do i complain to the fos next week, or do i complain to somebody else over the lack of response on there part. any help would be gratefully recieved.
  • only thing we have had from redcats is the first letter, giving two totals and a 'we wont be paying' comment, then the last letter saying that they are not covered by the regulations. SOOOOOO if they cant produce an agreement, is it fair to say that she doesnt have to pay?? or am being meean????

    I'm not surprised, its so frustrating......:mad: .
    Right regarding your request for information if nothing has arrived by next Tuesday I would contact the ICO, and the letter of complaint about PPI, if that was the "final response" and they have mentioned the FOS, plus enclosed a leaflet, then yes get a complain in with the FOS.
    If they have not mentioned the FOS on first response then write again and tell them you are not satisfied with their response and would appreciate it if they will reconsider your complaint on letter dated xx/xx/xxxx.

    When did they receive your letter of complaint (date on letter then for instance)?
    And when did they send you the first response (date on their letter)?
    We can work out how long they have left on the 2nd letter of complaint then ?

    Just remind me to save me going right back on the posts for now, when was this taken out - what year ?

    I was thinking as they will not supply you with a copy of the agreement, maybe if you contact the ICO (Information commissioners office), see what they have to say, they may even look into this for you.

    the first letter 16-10-08
    response letter 22-10-08 this did not acknoleged all my claims, ie; previous acc; the response was to my existing account, but the complaint was for past & present.
    2nd letter 24-10-08 no response
    sent 3rd 12-11-08 no response to date.
    all these were sent to the complaints & quality assurance dep
    documentation was asked for on 16-10-08 from where i had loan from & complaints. all letters were recorded delivery. 40 days to resolve is clearly not on there agenda.

    Okay I feel you need to get in touch with the Financial ombudsman about this now and explain to them the situation, because I know they say give them 8 weeks to respond, but that is for the first letter and you have no response since, so hun give these a ring here:

    There are also complaint forms on that page too, so first explain the situation in case they give a certain date to hear from the firm, they may say wait until a certain date and if not successful and also if not heard then send in a complaint.
    If you go ahead with the complaint now, enclose copies of all correspondence to help your case.;)

    They should be able to tell you, you can also request for the FOS to write to them for you, but they will do this as a standard 8 weeks response, although the chances are they will respond if sent from the FOS.

    Give them a ring hun and let us know what they say - no harm done by asking and good luck.

    Was wondering if anyone could help with this:
    OH took an overdraft in 1999 to which payment protection was added, he did not authorise this as he was medically exempt anyway, then in 2004 I became a joint account holder, apparantly the single PPI was cancelled and a joint application made, I did not sign for this and would not have needed it as I was unemployed at the time. We only found out that we were paying for this in August this year when we tried to close the account. We complained immediately and have just received our final response from Barclays saying that they will give a refund from when I joined the account but not prior to that as it falls out of the timescale allowed for complaints, they also said that it was an unreasonable length of time after the product was sold to the time that we cancelled it. The guy that we have been dealing with was awful,it has felt as though we were under investigation for fraud or something, calling us up to four times a day asking the same questions over and over again. I have been so upset by the way Barclays have dealt with this that I am tempted to just take the money they have offered as we are desperate for the money and I know it will take ages if we go to the FO. I rang the FO to see if we had a chance of reclaiming the rest either up to the last six years or back to 1999 but she said she couldn't advise. If we accept the offer it is full and final. What would anyone else do? xx

    as i have previously said with our financial difficulties were behind on the existing loan, to which were in court on the 3rd dec for repossession. they did the paperwork for this. i think the problem with blackhorse is there all in house. sales = insurance= legal. so all contact is monitored from each department to abuse the system. i have applyed for a ajournment, until they resolve this complaint, waiting to here back from courts. not much to look forward to at the moment, but im not going down without a fight. thanks for the advise , im getting all paperwork ready to phone FOS
