PPI Reclaiming discussion Part III

i did sent a subject access request. it just wasnt a copy of what is on here. i headed it 'subject access request' and ask for all the right things, transcripts of phone calls, copies of agreements for the account and for the PPI. but all i got back was a couple of letters!!
think they are failing miserably.
shall i sent ANOTHER sar?? OR TELL THEM I AM REPORTING THEM TO WHOEVER, FOR FAILING TO PRODUCE THE REQUESTED INFORMATION??0 -

You could try calling the ICO, do you know the date when you sent your sar request, the ICO will want to know if you have allowed them 40days.
I would'nt send another SAR if you have already done this.

i will know the date by the letter on my 'puter at home, plus the slip for recorded delivery. its certainly more than 40 days.
what/who are the ICO??
is there nothing can be done to get them to refund it, without the going to court?? its something my daughter just cannot afford to do.xx0 -

Unfortunately I and others are in the same situation, I have enough evidence to put forward to a court should I have to, I can't afford it myself but its a matter of principle and fighting for what is yours.

Can anyone help me please with trying to reclaim my PPI charges from Barclayloan?
I've been trawling through the forums for a while now but not found anything similar to my case which has had the outcome posted.
I took out a loan in September 2002 for £1500. I was working part time on irregular shifts at a supermarket at the time. I wanted the loan for a car. It was a long time ago but I don't remember being given an option to choose whether to have the PPI or not. It says in my T&C that "if the cash loan, premium loan or Barclayloan protection is ended then the whole agreement will end. You may then make a new loan application for any outstanding balance and for any further money you require". Which gives the impression that if I did not take the PPI cover out I would not be able to have the loan.
The figures are as follows:
APR 20.9% :eek:
Amount of loan
Cash Loan £1500
Premium Loan £381.95
Total charge for credit
Cash Loan £845
Premium Loan £215.05
Total amount payable
Cash Loan £2345.40
Premium Loan £597
Monthly repayments
Cash Loan £39.09
Premium Loan £9.95
= £49.04
Number of repayments

I have now paid off the loan but would like to claim back this PPI for the following reasons:
I do not believe I should have been sold the policy when I was only working part time as a)I do not think the sales advisor asked if I was working part or full time and b)when I lost my part time job I went to the bank to claim and they said I could only claim if I had been in a full time job for over a year
I have only ever had one full time job in my life, which I got midway through my loan, and am a full time student now anyway. There was no question of me saying I worked full time when I worked part time, so this should have been checked.
I rang up to cancel the insurance and was told I couldn't.
So I have paid almost double the original loan and am quite furious.
Any ideas what my next step is and who do I need to send the first template letter to?

Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.
You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.
After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.
