    Yeah, just got it and thanks Di and maxdp...

    It has given me some sort of idea of how these things work. I just wish I do get some comeback with FIrstplus insurers. My god can I add stress to that one...

    Hope it does not confuse you too much lol, you will come across the final decision first then the provisional one after.;)

    I hope you get some feedback as well from your insurers, better be good too !

    As you know the FOS sent a letter for me but would the insurers also write back to the FOS or just me? that bit I do not know as I have never had the FOS to write on my behalf before, as they had already done this for me by the time I received the letter from them the other day.......:confused:

    Its just the waiting game now. Have you asked for the fast track as you do know this goes back of the queue again.

    I asked but again and said about the mortgage etc and got told it was for other things and mainly life or death...That is all i get told... What is the criteria for the fast track??
  • Thanks for your quick reply. I did know that I had taken out ppi but as far as I can remember didn't have any choice but I can't prove it. I've not made any claims on it as yet and the loan continues until June 2010.

    If you did not have any choice like you are saying but cannot prove it then perhaps requesting a SAR from them would prove this.

    This is all the information that the company hold on you and its cost £10 and they have 40 days to comply with it by law.

    Were you sold this by a broker or the loan company themselves...

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.






    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Hi hun
    I did not know this actual one was being fast tracked, even though I did request this on the complaint form (which was for the endeavour one) because I thought they had only just looked at this in order to know to have it looked at, before its moved onto the adjucator sort of thing.

    As the FOS wrote to them would I have to ask for fast track again now or if it comes to sending the complaint form to the FOS?

    Have you had the chance to look at the attachment yet ?;)

    I'm having a thinking moment here:

    In my sar I have 2 signed copies of credit agreements, one originally as discussed for £449.57 per month another for £494.75, the £494.75 is the one that was processed for some reason? trying to figure it out

    Mine Firstplus one was put before an adjudicator to look at as to if I actually had a complaint within jurisdiction cause I kept emailing asking them daily. I have spoken to the person who is writing to the insurer and told them that my mortgage goes up next month and all the rest but I was again told fast tracking is not for this reason. Its about life and death. Its what I always get told. :confused: . I wondered just how hard up you had to be to be able to claim fast track... I bet if you looked at our income and then took away the mortgage and it was able to be looked at this way then we would certainly be able to claim in the fast tracking. So annoyed that we are not looked into as "hard up". It should go on what you are left with after paying for where you live. Remember our mortgage is so high cause we put the firstplus rip off loan on it in the first place.
