    The first loan was taken out in 2002, this was settled in 2006 when we refinanced to get another loan, we then settled that loan in 2007, we did get some rebate's back, but it is the whole PPI we want, as mentioned before we were asked questions and according to our answers, we would want to have protection, but it was never explained as PPI or what was getting added to the loan, the 2nd one had a tick in the box for PPI which wasn't done by us, and this is clear in the paperwork with our handwriting and the tick in the box.

    I will prepare letter this evening or tomorrow and get it sent away.

    What is an SAR?

    The loans were with Clydesdale Bank and I think were covered by FSA back then, they certainly didn't say anything about not being covered in the letters at the time.

    Right then hunni, thanks for the info.

    You will have to write to the broker who arranged your loan and then the lender for the 2nd loan. Not unless you had this arranged by the same lender for both.

    Marshallka should be here sometime and will explain how this works when it comes to already receiving a part rebate where you want to reclaim the rest of it and so and the last one it should be the whole lot of it.

    If you give me a few mins myself or one of us will post up a SAR which is a Subject access request where they must supply everything they have on you, if you already have the agreements on hand though this should be okay or you could just request for copies of the agreements, these may be free or they may charge a £1, you can also request for a written breakdown for the calculations on the settlement of the loans which will confirm how this was calculated and what went where.

    With the SAR it costs £10 cheque or postal order where they have to provide this by 40 days, this must include everything they have on you also recorded phone calls etc.

    I will dig out the SAR template and add it here shortly.;)

I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization:
    -Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same.

    - A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization.

    -Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.

    -Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.

Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

    -Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.

    I enclose a cheque in the sum of £10 to cover your fee.

    When I go to the doctors I am going to ask him if I can see a pyshcologist, suffered from panic attacks yrs ago and he was really good. CBT is no good for me just yet.
    It is hard and probably the one of the hardest things you will ever have to do - its why they are so dangerous in my eyes - its the withdrawal that can be the worst and thats why so many people spend so long on them. None of these medications were EVER designed for long term use but the docs don't know how to help people off them so just give out more prescriptions. Its a vicious circle. We are always here Dreamer you know...

    I have known a load in my profession but how many would I use if I needed to, probably about 2 or 3. That is just my opinion but believe in changes in life style etc alongside conventional therapy.

    Often the only therapists that most people get to see on the national health is a counsellor and they are not properly trained. The waiting list for clinical psychology is so long but it is the therapy that is the best and often one to one and can take years of talking. Well worth it but like I say, can take years and years...

    I've dug out all the paperwork, have the original papers and all the letters from the first attempt at reclaim.
    On loan 1, 2002, they sent us a copy of the form we filled in, well it was filled in by the bank person, and if I remember asked us for the information, on that form the box for PPI has been ticked,, the only thing filled in by us is the signature!
    On loan 2, 2006, they have sent us a copy of the demands and needs questionnaire which you can't read because it is a photocopy, but there are no questions, just that we have no other protection and they recommend we take PPI.
    Obviously they refused on all grounds to a refund and their words in summary were
    "In summary then I cannot uphold your complaint. In accordance with the standards applicable at the time and the evidence available to me I conclude the Bank's representatives acted with due skill, care and dilligence in arranging the policies. I also believe that you made an informed choice in respect of the suitability of the product to meet your overall objective".

    They had also said "You will appreciate that I cannot comment on what may or may not have been said during the discussions between you and the member of staff involved. I assure you, however, that all staff involved in the sale of regulated products are aware of their duties and responsibilities."
