    Hello there.

    Have you still the terms and conditions of this policy?

    And any paperwork/documents relating to this product?

    I will check on my policy with lloyds and will check the exclusions out for you, I will have to dig these out, but it could be worth your while reclaiming this back, is this still active?

    A SAR may be useful as well where they must provide everything they have on you, going back as far as 6 years, although you may be lucky to receive info going back even further as I did with mine with this company.

    There is a template letter for this SAR, known as a Subject Access Request, but there is a £10 cheque or postal order charge for this, and they must comply within 40 days, post by recorded delivery.

    Dear

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Hi SAR template above, here now is the link if you want to check the PPI reclaiming out, for other reasons as well, there is also a template reclaiming letter but try to out this into your own words as much as possible with your own reasons, there may also be other reasons relating to your claim as well, they have 8 weeks to respond in full, another letter maybe required for consideration if not successful first time round, post by recorded delivery like with all letter to these companies for your proof of posting, let us know the outcome and we shall take it from there and of course if you require further help and info, please just yell anytime.;)

    So your still waiting for these complaints to be moved on then ?:eek:

    If your struggling financially right now, I know this is the case for many now, but let them know and request if this can be fast tracked, even fast tracked can take time, but an email now and again may give them a bit of a nudge, to be honest if yours has been within the FOS since almost a year ago, I would of thought there would be some movement on this by now, even though there are high volumes of these complaints.

    Good luck and please let us know what is what with these, fingers crossed.;)

    can i claim back for my mortgage insurance the same way as my loan insurance
  • Dave you have a better chance at the mortgage claim that you do with a secured loan as there are more regulations with regards to mortgage insurance.

    Just to keep you updated with GE Money. Got my national insurance report after 5 weeks (arrrgh!) and they had sent me every year bar the one I asekd for (annoying!) have now sent me out the one for 2002 as requested and I am going to send to GE Money today. GE asked me to provide evidence from october 2002 via my NI report to show I was not working - NI can only send you your contributions for the year (which were £180.00). GE money need evidence I did not work more than 16 hours a week - which I clearly didnt as only paid £180 in the whole year!Do you think this will be ok?

    i know i am abit late to the reclaiming party but i just wanted to ask some questions??

    at xmas time i got a letter from egg saying they may have missold me ppi on my credit card. i didnt even know i had this!!
    anyway there is a number on it to call and i just wanted to know how easy it is to prove you were missold it?
    is there anything i need to prove? or do they take your word for it etc???

    (i know i have left it for quite a while but i really have had no spare time for this due to family illness.)

    thanks in advance for any advice

    Hi there L.

    That should be fine, they may be using this to stall matters as well in hope you don't have anything to prove, any more problems on this let us know hun, we shall try to work this out.;)

    What annoys me is that they ask for all this stuff and yet they should really have records from when you first had the finance, ok this can depend on how long ago this was, the years etc but still, if its a running active account, I do think they should keep the records of your account as from the start.;)

    Wow they done this out of the blue without you even writing to them then ?

    Well if it were them that wrote you to tell you this they must have records that you did have this.

    Its not too late, they have already admitted this to you, and this was the actual company EGG that wrote to you was it, just to double check ?
