    Right so you have the statements going back as far as 6 years then I take it?
    And there is no charges actually showing the amounts over £12, if that was the case in 2005, what about as from 2003 (6 years ago)?

    If you've not got these statements and have not done so yet, request a SAR.;)
    Have you also tried checking this out on the charges thread hun and see what they say there?;)

    Hi Incipience, I switched off earlier last night, sorry I missed this.

    I would have said the Sales guy at the store at first, as he went through all the explaining of the product and the sale, and arranged the HP for this, however this due to our latest discussions of whom to pursue, I would be in two minds here and say complain to FP, they want the store staff to sell then in return they get paid good commission to sell this product.;)
    Have I confused matters again ?? oops

    probably because that proves the mis selling part. They have to give it you. Get in touch with them and request it. I presume it goes in your favour with FOS if they with holding information.

    Ocean were the broker. Blemain Finance were the lenders.

    Incidently when I contacted Blemain to cancel the policy they offered a refund on the understanding that I didnt lodge a claim for mis selling with FOS. I told them to get stuffed. Politely of course.

    As a point of law, this example was taken verbatim from a consumer law book, and the party liable was indeed the Finance Company.

    Goes to show you that not all is what you may assume.

    Yes I agree Incipience, no wonder we're all running round in circles with our complaints, the finance companies do not want to admit liability, but afterall like your post says, its all down to the finance company in the first place.
    I am making points and notes of this Incipience, thanks for posting for others here to be aware of this.;)

    The sales guy I suppose is acting as the broker and you would therefore go to the salesguy who would then probably send you off to who your agreement is with?
