hi,
my hubby has had 2 halifax loans in the past but we have no copies of the agreement etc, whats the best way to go about reclaiming ppi?

You can request all the paperwork from Halifax using the below template letter, enclosing a £10 fee, they should send all info within 40days. I have highlighted the telephone conversation bit on the letter as some companies seem to be with-holding these.
When did your hubby take out these loans? Companies normally only keep info for a period of 6yrs.
Can I ask how your hubby was mis-sold the ppi?

In the first part under the Data Protection Act 1998:
Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.
Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.
If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.
For the avoidance of any and all doubt, I reiterate:
I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).
If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).
Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.
I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.
I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.
You have 40 days in which to comply with this request.
This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

I am currently persuing ocean finance on two loans.
I too wrote to the wrong company originally. Blemain Finance who gave me the same response. I started my claim in May 2008. Because of the mix ups and confusion caused by each company not taking responsibility it took til september until I was able to send everything off to financial ombudsman.
I finally received a letter on Friday from FOS (after nice reminders via e-mail) telling me they now had all the information they required and my case is now waiting an adjudicator. I am really hoping it wont be too much longer before I get a decision and I have been told that even at this stage I may still lose. It depends on what the adjudicator decides.
Don't give up. These companies are the biggest rip off merchants ever. They prey on people who are already in financial dificulties (lets face it we wouldnt use them otherwise) and with all the hidden costs and extra add ons put us in an even more vulnerable position than we were in originally.
I will keep you posted on the outcome of my personal case and I wish you all the luck in the world with yours.0 -

I too wrote to the wrong company originally. Blemain Finance who gave me the same response. I started my claim in May 2008. Because of the mix ups and confusion caused by each company not taking responsibility it took til september until I was able to send everything off to financial ombudsman.
I finally received a letter on Friday from FOS (after nice reminders via e-mail) telling me they now had all the information they required and my case is now waiting an adjudicator. I too have two complaints regarding Ocean Finance with the FOS.
There must be quite a few people going complaining about Ocean, but I have not heard of anyone getting a result through the FOS0 -
Hello peeps... and especially to di3004 for the support and advice. Just to update before I finish my shift, have completed the questionnaire and am returning this. One thing I added was the SAR template thats posted on here as I know there were several heated discussions re the PPI years ago that I never followed up on. What they dont know is I have the dates and times of the calls noted on my paperwork so cant wait to see whats included.
Just wanted to say a big thank you to you all on here, things like these templates make such a difference empowering people and the support is second to none, your all :A . Well will sign off now but good luck to you all and will update you as soon as I hear more. P.s about to start the same thing with lloyds as well.

I see the FOS looked into this in who to pursue to, due to the confusion and the messing you had by the seems of things.

Both loans brokered and PPI arranged by Ocean and the lenders were Nemo, who I know you had dealings with and the other was GE Money.
I had no problem getting the lenders to point the finger at Ocean, so that helped push things along both complaints now with the FOS. First one went in at the end of october and the other went in at the end of November. But they are dealing with both together. I hope this is a good thing(fingers crossed)0 -
