You can request all the paperwork from Halifax using the below template letter, enclosing a £10 fee, they should send all info within 40days. I have highlighted the telephone conversation bit on the letter as some companies seem to be with-holding these.
When did your hubby take out these loans? Companies normally only keep info for a period of 6yrs.
Can I ask how your hubby was mis-sold the ppi?

In the first part under the Data Protection Act 1998:
Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.
Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.
If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.
For the avoidance of any and all doubt, I reiterate:
I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).
If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).
Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.
I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.
I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.
You have 40 days in which to comply with this request.
This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

They were both over 6 years ago now i think, or nearing that time.
He was told that even though halifax is his bank he wouldnt get the loan without insurance, as he needed them he just agreed being none the wiser! Thanks for the info.....0 -

Remember on my post yesterday I told you that I had 2 loans with the same lender of Nemo, well the 2nd one was won through the FOS, and told me that I should pursue this through the brokers for the first loan, although it was the 2nd loan I only actually complained about to the FOS anyway, but they were just aware of the first loan.
Now this complaint is now within the FSCS due to the broker company dissolved last year or so ago and also on the files with the liquidators Begbies and Traynor, do you think its worth my while writing back to Nemo on this first complaint as I have not done so yet on this first loan arranged by the broker? Even is this is within the FSCS.....as this can always be withdrawn I suppose.......
What would be your best advice and info you could give me on this please?

my hubby has had 2 halifax loans in the past but we have no copies of the agreement etc, whats the best way to go about reclaiming ppi?

I see that dreamer have already posted up the SAR for you.;)
Do this SAR in hubby's name then, then its only the £10 cheque they require, if you were joint with him the main of the finance companies expect you to request for this in your own right in your own name or just add 2 signatures on the same letter but then its another £10 payment, although you can double check with them first if you want to by contacting them.;) (that's if you want to request for an SAR for yourself as well)
Now this will go as far back as 6 years in them providing the information, yet some of mine I was lucky and received docs from earlier years.
Its well worth you giving it a try and let us know what happens from there so we can move on if required to the next step.

You will find some useful PPI information and a template letter, but try to use your own words and as much info as possible to support the complaint, they have 8 weeks to respond in full, post by recorded delivery.
Hopefully before you do this reclaiming letter the SAR information you require will come back way before the 40 days that they are entitled to, and with a bit of luck some useful documents within the SAR as well.;)

I just wanted to let you know the good news! I posted a letter to Littlewoods Personal Finance on 05/01/09 to claim back my mis-sold PPI. I received a letter today which I was expecting to be a standard reply - but nope. It was a cheque for the full refund plus 8% interest!!!!

Mine is not a good news story I'm afraid-I have been trying to reclaim about £1000 in mis-sold PPI from Littlewoods Finance Company Ltd since September 2007 (I am an insulin dependant diabetic and was NOT asked any questions about my medical history when the insurance was sold and I was not informed about the relevant exclusions from the policy). Littlewoods denied my claim and then went on to cite that since my Policy was sold before 22/12/2003 and they were not a member of the Dispute Resolution Service until then I could not refer them to the Financial Ombudsman Service.
I therefore took my claim to County Court and it was finally heard on 17 November 2008 but was dismissed by the judge because he said that Littlewoods were not obliged to request my medical history and that in fact I should have volunteered the information to them myself!!0 -

I would write to them as you do for loan insurance if you feel you were mis sold this for any reason, give it a try.

As I have never dealt with reclaiming on Mortgate protection I am not certain if there is another form of letter to use this or the same as the PPI reclaiming letter, just change the wording and your reasons.

I am so sorry to hear of that.
It does not help if they were not covered by these regulators where cases are more likely to be dismissed.

why do companies withhold copies of the phone conversations? Have recently recieved my SAR request from the Halifax but there is no copy of the phone conversation0

We are in the same position. We paid for a SAR and received loads of paperwork but no recordings. Iv'e written back and requested them so hopefully should have them by the end of the week.0
