New to posting but been reading messages for a few days - unsure what to make of this! I would have thought Tesco should take blame, if only to keep OP happy!0

That doesn't make much business sense. It's basically saying Tescos want customers to sue them (which is what will happen if they take the blame, the op was interested in compensation). You're not going to make much money by wanting customers to sue you to keep happy!
Perhaps you mean send a bunch of flowers but only as a goodwill gesture?0 -
Yeah, I guess what I mean is, they'll say they don't think it was their fault but sorry it happened in their store, he's a voucher etc, something like that.
I (like yourself!) don't agree with lets sue everyone - but I just think maybe a nice touch to keep customer sweet (but avoiding acual blame for event)0 -

Recently had a vase fall from a top shelf in tesco's filled out the injury forms etc then went straight to hospital to find I had broken my toe. 18inch vase hit my toe and I did have trainers and socks on so it had hit it with some force. So I contacted my insurers legal cover they put me in touch with a firm of Solicitors who looked at my claim and have said they will not take on the case as they cannot prove it was Tescos fault? I could not believe this as you dont expect to go into a store and come out injured just by perusing the shelves or do you? So I am left thinking they just didnt want to fight the case ? And what happened to the other side having to disprove a claim? I am also 20 weeks pregnant and had to sign a disclaimer at the hospital to allow them to X ray me. Any views or expert opinions, advice greatly received.

I think we could probably settle all of this by watching the CCTV.
Now, am I right in the following? Under the Data Protection Act, if a company has CCTV footage of you then they are legally obliged to let you see it (for a nominal fee, I believe).
So why don't you write to Tescos with the date, time abd location and ask for the footage. Have a look at it. If you still think it shows Tescos at fault then sue. If you don't then don't.0
