Injured in Tesco's

Recently had a vase fall from a top shelf in tesco's filled out the injury forms etc then went straight to hospital to find I had broken my toe. 18inch vase hit my toe and I did have trainers and socks on so it had hit it with some force. So I contacted my insurers legal cover they put me in touch with a firm of Solicitors who looked at my claim and have said they will not take on the case as they cannot prove it was Tescos fault? I could not believe this as you dont expect to go into a store and come out injured just by perusing the shelves or do you? So I am left thinking they just didnt want to fight the case ? And what happened to the other side having to disprove a claim? I am also 20 weeks pregnant and had to sign a disclaimer at the hospital to allow them to X ray me. Any views or expert opinions, advice greatly received.

    How did the vase fall?

    Was it knocked by someone/something?

    Was it stacked on the shelf so it was likely to fall?

    The reason the solicitors won't touch the case is anyone could have put it there. Tesco cannot patrol every part of the shop all the time, and it may of been placed there by a customer, therefore it is not Tesco's fault.

    Basically what the solicitor said but the aisle we were in had a cctv camera looking right down it so they must have caught what happened on it. It literally came from nowhere one minute I was speaking to my husband the next I was in agony and a vase was smashing into pieces. the only ones of this style we could see were on the very top shelf.

    A vase wouldn't fall on it's own without force. It it was a dodgy display loads would have fallen. They probably know it's quite likely you either knocked something or there was something going on that caused it.

    You must have been stood infront of the section otherwise it wouldn't have hit your toe so they probably think it's quiet likely you might have done something to cause it.

    Sorry to hear about your toe, I've broken a toe before, and i just left it, it sorted itself.

    Being 20 weeks pregnant shouldn't really come into the equation.

    You want money because of an accident. This country is bonkers.

    Things like that don't come out of nowhere! It sounds like poltergeist activity now, I suppose you can't sue the dead!

    Out of interest, what have Tescos said aboutthe whole incident? Are they denying any fault?

    We were stood to the side and the top shelves were stacked full of the vases. The particular display we had'nt even touched. As stated literally came from nowhere.
