    In fairness to the OP, its perfectly possible that the shelf could have been knocked from the other side of the aisle.

    I used to work there **shudder** and stack at nights, and its possible to bump the shelf behind and have something fall.

    i hope your toe gets better , especially with you being pregnant you will be putting more pressure on foot when you stand up , i would suggest the best way to resolve this whole situation is to have your baby in tesco then they give you free baby stuff,

    i think suing then for a broken toe is slightly ridiculous however you could always write about your disatisfaction

    I know nothing about shelf stacking, but could it be said that Tesco should put heavy items on lower shelves?

    Or am I talking rubbish?

    Certainly when I was there (and Im going back 12 years now) it was pile it up get it out. Christmas was probably worse as all the tins of sweets and biscuits were stacked impossibly high on the top shelf just to free up the stock room. The guys that filled that aisle needed ladders, to me that was an accident waiting to happen when stacked so high.

    In theory though Holly I agree with you, but in practice its just not possible, especially when you consider Wine bottles etc

    If you look at the bottom of tesco's shelving there is something called a "Kick Rail" if this is missing the shelf can be knocked easily by a trolley. In other cases say cereal was stacked quite high on one side, reaching for one of those and having one fall would be enough to send what's on the shelf behind toppling.

    Whilst I dont agree with the whole compensation thing, I do think OP deserves an apology and a nice bunch of flowers.

    Legal position - Tesco have to have a reasonably safe environment for you to be in. This will require them to conduct checks that the store is safe. If you can demonstrate that there system was inadequate or that they did not follow their system, then they are liable to you for damages.

    Insurance backed solicitors are generally rubbish when it comes to having to prove a claim. If it is handed to them on a plate they are happy.

    Subject to the evidence, you have a claim. If you want to proceed suggest you either get in touch with Tesco yourself - NOT CUSTOMER SERVICE - or instruct different solicitors to pursue.

    This is exactly what I don't understand? It would be easier to deal with Tesco directly first and find out what conclusions they have come to as to why this occurred. Contacting a solicitor in the first instance seems a complete overreaction which is probably why the comments have been coming the way they have.

    Whatever Tesco's argument is, a customer has still left their shop sustaining a broken bone. By the sounds of it, it's lucky that the accident wasn't worse as it could have smashed over her head.

    They need to be providing answers. Whether it was an accident casued by the OP or Tesco, it shouldn't be one that is allowed to repeat itself. I certainly wouldn't be happy if I went in to the same store and had a similar incident or worse happen to me or my family and I subsequently found out about the OPs prior experience.

    This needs to be investigated, blame apportioned correctly, necessary procedures put in place to avoid a repeat occurance and in the very least, the OP needs an apology and renumeration for any out of pocket expenses (of which I'm sure there are some if a trip to the hospital was warranted!).

    I disagree. If you are to make a claim then you either a) do it yourself if you know what you are doing; or b) get someone who does know what they are doing to do it.

    Ive been involved in plenty of legal cases where people have, in good faith, had a crack at the claim letter and mucked things up.
  • I think it needs persuing as a serious complaint, if for no other reason than to make sure Tesco take it seriously and ensure the shelves are safely stacked. (if thats what caused the accident)

    I shudder to think what a falling vase could have done to my 3 year old child if it broke the OP's toe.

    It does come into the equation as due to the accident the OP had to have an X-ray which is potentially very harmful during pregnancy, she wouldnt have had to put her baby at risk if the accident had never occured so its all relevant.
