Actually I also don't think the OP should not persue a legal claim and should instead just complain.0 -
Then it's back to square one, is Tescos fault in option one? I would say the most likely explanation is either the op or another customer didn't put it back properly. It's already mentioned that the definition of "reasonable" isn't Tescos having one member of staff per customer on the shop floor to check their every move isn't going to cause an accident.
I think this is why the op has stuggled so far with pursuing any claim.
You're probably right...I was never making any statement about whether or not I thought it was Tesco's fault. Was just making the point that the vase could have *just fallen off* without too much/any force being applied to it...these things happen.0 -

You have to stop selling everything everywhere with that attitude.
I bet you the vases were the lightest item in that section. You obviously have to group similar items together, eg lamps, lightbulbs, cooking equipment. I bet in that section it was either a section for vases where they had the heaviest lower down and lighter ones at the top or the other items there were heavier than the vases.0 -

Tim I agree with you, I wouldn't sue either, I would just be bloody annoyed that my toe was broken, but I would put a complaint in.

SOMEONE needs to be notified that this occured, and whilst it may have been a random customer, it was still in Tesco's store. Its hard to prevent things like this happening but i feel the Op still has every right to say 'could it have been prevented' 'was anyone to blame' and if they felt that they needed to put that into the hands of an expert (ie legal representation) after feeling brushed off in store, then thats up to them.

thats not enough to ensure it doesnt happen again though, the accident book just provides a record of the account at the time, its not used to impliment change.
im not saying the Op should sue, just that shrugging it off as one of those things seems a bit of a under-reaction in this case.
