  • i dont know about 'compensation culture' but the 'jump on the bandwagon, make massive assumptions about a person from one post and only join the thread to feel morally superior culture' seems to be rife here !!

good luck OP, I personally feel you shouldnt persue a legal claim but send a strongly worded complaint to head office and ensure you feel properly dealt with ;)

Was that aimed at me? hey ho :p but I do now feel morally superior

Actually I also don't think the OP should not persue a legal claim and should instead just complain.

Then it's back to square one, is Tescos fault in option one? I would say the most likely explanation is either the op or another customer didn't put it back properly. It's already mentioned that the definition of "reasonable" isn't Tescos having one member of staff per customer on the shop floor to check their every move isn't going to cause an accident.

I think this is why the op has stuggled so far with pursuing any claim.

You're probably right...I was never making any statement about whether or not I thought it was Tesco's fault. Was just making the point that the vase could have *just fallen off* without too much/any force being applied to it...these things happen.

LOL you make me laugh Tim on this wet gloomy day

It is tesco's fault they shouldn't have heavy vases which could fall off on high shelves full stop

Well thats like saying they shouldn't sell anything just incase somehow someone has an accident with it.

You have to stop selling everything everywhere with that attitude.

I bet you the vases were the lightest item in that section. You obviously have to group similar items together, eg lamps, lightbulbs, cooking equipment. I bet in that section it was either a section for vases where they had the heaviest lower down and lighter ones at the top or the other items there were heavier than the vases.

Tim I agree with you, I wouldn't sue either, I would just be bloody annoyed that my toe was broken, but I would put a complaint in.

    Going home now.

no not aimed at you at all, in fact im soooo slow at typing i didnt even see your post :p have one of them back though ;)

    uktim29,

SOMEONE needs to be notified that this occured, and whilst it may have been a random customer, it was still in Tesco's store. Its hard to prevent things like this happening but i feel the Op still has every right to say 'could it have been prevented' 'was anyone to blame' and if they felt that they needed to put that into the hands of an expert (ie legal representation) after feeling brushed off in store, then thats up to them.

Thats what accident books are for which Tesco have obviously provided and the op filled in as it's written in her first post.

thats not enough to ensure it doesnt happen again though, the accident book just provides a record of the account at the time, its not used to impliment change.

im not saying the Op should sue, just that shrugging it off as one of those things seems a bit of a under-reaction in this case.

ps clareEmily, no need to feel silly, its so hard to write things and make sure they are taken in the right way, and by the right people.
