That's quite incredible, but why I didn't foresee that is beyond me.
How utterly bizarre, but I think is a good reason not to enter into any deal with such a company.
A legal jurisdiction clause nominating the USA really is quite laughable, but indicative of what you're dealing with.
I quote from those terms
You agree to pay all necessary solicitor's fees and any cost of litigation that arises from The Company or its affiliates having to take any action against You to enforce these Terms of Use, that is in addition, to any other relief, at law or in equity, to which The Company may be entitled to. All expenses of such action will be recovered from You.

The good thing is that unfair terms and conditions will be set aside a UK court, and these are nothing short of bizarre.
If you see terms and condition like that - don't buy, don't sign, and just walk away with your hands in your pocket and don't bother looking back.
I've heard of the legal expression 'invitation to treat' - this is an invitation to walk away.
'Cutting to the quick' - unless you could claim back from your card company then the alternative of claiming through the courts would be complex with clauses like that included, then you''d be reliant on the goodwill of the company and director involved. I say nothing.0 -

Thanks for your post. Your opinion is a valid one and probably right. I'm sure I got a bit carried away with the ad hominem stuff against Gomer. And, yes, I am vain.
I don't know about Gomer, though. I just detect a whiff of the demagogue about the dude and I just think he's to be resisted, and leaving the petty stuff aside, there is a valid issue about how we use these forums, and whether the loudest mouths are always the ones we should allow to dictate the terms.
Even though the Lapland park was a clear cut scam, it's not absolutely all black and white as I'm sure that some involved in the park were in good faith (it seems the huskies fall into this category and they were not malnourished after all), and not everyone who dares to disagree with Gomer is automatically Victor Mears in disguise.
There I go again ! I'll probably get told off !
These forums are such a valuable tool that we should all take care. It's that which really matters, and, as somebody who is sometimes wrong, it is tricky to know how to challenge those who are always right in the right way.

At the end of the day some people prefer aggression to knowledge but what really counts here is that the vets and the RSPCA are behind the owners of the dogs 100%. The dogs were not taken away but sent back to their loving home where they have a great life. I rest my case.0

I agree that it is quite bad how other innocent peoples businesses have been ruined. I'm sure the website designer thought this was "just another job", and was clueless to the debacle that would come from it all. However the terms and conditions laid out on the lapland new forest website is clearly just copy and pasted from somewhere else, they know that no one reads that but as long as something is there it makes it look all the more real.0
